ORDER QAMAR-UL-HAQ BHATTI (JUDICIAL MEMBERS),,,.miscellaneous application has been filed at the instance of the taxpayer-appellant seeking stay against the order No. 295/A-ll passed by the Commissioner Inland Revenue(Appeals-ll), Lahore dated 19.02.2016 subject to payment of 20% of the disputed tax demand created by the revenue. 2 The learned counsel for the taxpayer-appellant contended that the during the proceedings before the learned CIR(Appeals- II), Lahore he did not give any gesture to pass stay order subject to payment of 20% of the impugned demand. Further contended that now the department is pressing hard for the recovery of the illegal tax demand as a result of which the learned CIR(Appeals-ll)'s order dated supra. It is further contended that the main appeal of the taxpayer-appellant is also pending for adjudication which was filed on 23.02.2016 in the office of the Appellate Tribunal Inland Revenue, Lahore and till to date no date of hearing has been fixed so far also argued that due to recovery proceedings of the department, the applicant is facing a lot of difficulties so, if the stay is not granted, the taxpayer-appellant would definitely suffer…
