THIS ORDER PASSED BY: MIAN SAEED IQBAL, ACCOUNTANT MEMBER: ---------------- The appeal has been filed by the appellant against the order No 266/2013 dated 02.05 2013 passed by the Learned Commissioner Inland Revenue (Appeals-III), Islamabad tor the tax years, 2009 on the following grounds. - 1. That the older of the learned CIR(A), Islamabad is bad in law and against the facts and circumstances of the case. 2. That the teamed CIR(A), Islamabad was not justified to delete the addition made on account of P& L expenses as the same was also confronted through notice u/s 122(9) during the course of assessment proceedings and the taxpayer remained unable to rebut the same in his reply. 3. That the appellant may be allowed to alter, amend, or add more grounds of appeal at the time of hearing. 2. Brief facts of the case are that the return of total income for the year under consideration was filed declaring income at Rs. 225,000/- and assessment was deemed to be completed u/s 120 of the Income Tax Ordinance, 2001. The ease of the taxpayer was selected for audit u/s 177 of the Income Tax Ordinance, 2001 and he was required to produce books of accounts and related documents.
