Brief facts of the case are that the taxpayer an individual filed return for the year under consideration declaring salary income at Rs.1,061,096/- the taxation Officer observed that tax liability on the said income worked out to Rs. 99,032/- but that the taxpayer had paid tax at Rs. 23,718/- only resulting in short fall of Rs.75,314/- the officer therefore confronted the taxpayer vide showcause dated 13.06.2012, to which statedly no response was made, and the deemed assessment u/s 120 was therefore rectified u/s 221 by charging the said short tax. 3.
