SHAHID IQBAL DHILLON, JUDICIAL MEMBER:------------------- Titled misc. application has been filed at the instance of the taxpayer seeking recall of our earlier order dated 12-12-2015 passed vide ITA No.374/LB/2013 (Tax year 2011). 2. The learned counsel of the taxpayer submitted that the above mentioned appeal was dismissed for non-prosecution. It was further submitted that on the due date the counsel of the taxpayer did not attend the court as he had moved out of city for some urgent matter. It was argued that the default was neither willful nor intentional.
