Industrial Relations Act, 2012 (X of 2012)-- ----Ss. 9(3), (4) & 6--Election schedule of internal election of N.B.O--Remedy of appeal--Issuance of provisional list of candidates--Final list of candidates--Dispute in relation to change of office bearers and can accord approval of change of officers of trade union of internal election of union--Validity--Every change of officers of registered trade unions is required to be notified by union to Registrar of Trade Unions--Registrar of trade unions has been invested with powers under Section 9(4) of Act to refuse to register change of officers of union or alteration if it has been in contravention of any of provisions of Act or be in violation of constitution of trade union/in respect of a dispute in relation to change of office bearers, Registrar may after satisfying himself with respect to existence of a dispute may direct for holding of fresh election under his supervision within meaning of Section 9(6), Act, 2012--Collusive acts etc have been committed by interested ones of union in issuance of the, election schedule which best suited only to unopposed elect candidates to various offices of union may call for production of some evidence, which is wanting at moment--After poll for office of Chairman of union, election result alongwith all other papers and documents are yet to be submitted to RTU to accord approval of change of officers of union or to direct for holding fresh election as case may NIRC did not deem it appropriate to pre-empt jurisdiction vesting in RTU at present stage of election process being reached to its final peak after a long litigation between parties in respect of internal election of union, in as much as; candidates who are contesting for office of Chairman of union have not even been impleaded as respondents in instant appeal.
