Criminal Procedure Code, 1898 (V of 1898)-- ----S. 497(2)--Bail, grant of--Entitlement--Further inquiry--Where the case of accused/petitioner became one of further inquiry and trial against him was not in sight in the near future, he could not be kept behind bars for an indefinite period--Bail granted. THIS JUDGMENT DELIVERED BY: ABDUL AZIZ KUNDI, JUSTICE---.--- On the basis of letter dated 23.4.2009 by Javed Iqbal, Manager, Allied Bank Ltd., The Mall Branch, Abbottabad complaining that he has received a complaint from one Shahid Butt maintaining Account No. 01-200-0512-7 Allied Bank Ltd., Rawlakot Branch, Azad Kashmir complaining that he had issued a Cheque No. 8632838 in favour of Raja Nadeem Ahmad for Rs.1,50/- who has withdrawn an amount of Rs.5,90,000/- through the said Cheque on 17.3.2009 by using "on Line" facility through his Account No. 01-100-9958-3 maintained at Allied Bank Ltd. The Mall Branch, Abbottabad and that internal investigation carried out by the Bank has revealed that on the date of payment, the cheque was in order and any tampering on the cheque could not be detected but with passage of time, however, minute examination of the cheque revealed that tampering has been made in amount as well as date of the cheque by applying a chemical which makes the actual/original writing disappear temporarily and tampering in the documents could not be noticed but with the passage of time, the effects of chemical goes down allowing the actual/original writing to reappear on the document. Accordingly, it was stated that Raja Nadeem Ahmad with his full particulars given therein has fraudulently withdrawn the amount of Rs.5,90,000/-. 2. After processing the said letter, Director, FIA, NWFP, Peshawar vide his letter dated 5.5.2009 directed registration of case. Consequently, case vide FIR No. 9/2009 was registered on 25.5.2009 at 1300 hours at Police Station, FIA CBC, Peshawar against Raja Nadeem Ahmad, accused/petitioner under Sections 420/468/471 PPC and investigation entrusted to Mr. Sardar Ullah Babar, Sub-Inspector, FIA, CBC Peshawar. 3.
