and\r\ncorrect. However, the precedent of \u003cspan class=SpellE\u003ehonourable\u003c/span\u003e Supreme\r\nCourt of Pakistan laid down in the case of S.M. Shaft Muhammad \u003cspan\r\nclass=SpellE\u003eZaidi\u003c/span\u003e through Legal Heirs v. \u003cspan class=SpellE\u003eMalik\u003c/span\u003e\r\n\u003cspan class=SpellE\u003eHassan\u003c/span\u003e Ali Khan (\u003cspan class=SpellE\u003eMoin\u003c/span\u003e)\r\nthrough Legal Heirs reported in 2002 SCMR 338 is often used for rejecting the\r\nplaint. It has been observed by the \u003cspan class=SpellE\u003ehonourable\u003c/span\u003e\r\nSupreme Court on Page No.342 (Para No.14) as under:\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003cspan style=\u0027letter-spacing:.2pt\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027margin-left:.5in;text-align:justify\u0027\u003e\u003cspan\r\nstyle=\u0027letter-spacing:.2pt\u0027\u003e\u0026quot;14. Besides, averments made in the plaint\r\nother material available on record which on its own strength is legally\r\nsufficient to completely refute the claim of the plaintiff, can also be looked\r\ninto for the purpose of rejection of the plaint. It does not necessarily mean\r\nthat the other material shall be taken as conclusive proof of the facts stated\r\ntherein, but it actually moderates that other material on its own intrinsic\r\nvalue be considered\u003cspan style=\u0027mso-tab-count:1\u0027\u003e \u003c/span\u003ealong with the\r\naverments made in the plaint.\u0026quot;\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003cspan style=\u0027letter-spacing:.2pt\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003cspan style=\u0027letter-spacing:.2pt\u0027\u003eThe\r\naforesaid observation of the \u003cspan class=SpellE\u003ehonourable\u003c/span\u003e Supreme Court\r\nof Pakistan too demonstrates that the averments of the plaint cannot be ignored\r\nstraightaway. In another case law of \u003cspan class=SpellE\u003ehonourable\u003c/span\u003e\r\nSupreme Court of Pakistan (Abdul \u003cspan class=SpellE\u003eWaris\u003c/span\u003e v. Muhammad \u003cspan\r\nclass=SpellE\u003eYousaf\u003c/span\u003e) reported \u003c/span\u003ein \u003cspan style=\u0027letter-spacing:\r\n.2pt\u0027\u003ePLD 1997 Supreme Court 366, it has \u003cspan class=SpellE\u003ebeen,observed\u003c/span\u003e\r\nby their lordships on Page No.371 by relying upon the case \u003cspan class=SpellE\u003eHaji\u003c/span\u003e\r\nAllah \u003cspan class=SpellE\u003eBakhsh\u003c/span\u003e v. \u003cspan class=SpellE\u003eAbdur\u003c/span\u003e \u003cspan\r\nclass=SpellE\u003eRehman\u003c/span\u003e 1995 SCMR 459. In the present case on the basis of the\r\ncontents of the plaint, it could not have been held that the plaint does not\r\ndisclose any cause of action or that relief claimed is undervalued and the\r\nplaintiff failed to correct. \u003cspan class=GramE\u003ethe\u003c/span\u003e valuation in spite of\r\nthe time fixed by the Court or the plaint written upon insufficient stamp-\r\npaper and the plaintiff failed to supply the requisite stamp-paper within the\r\ntime fixed by the Court or that the suit was barred from the statement in the\r\nplaint by any law. In this view of the matter, the learned Civil Judge was\r\ncompetent to reject the above application under Order VII, Rule 11, C.P.C: The\r\npetitioner is free to raise whatever legal or factual pleas are available to\r\nhim to show that the suit is not maintainable but the rejection of the plaint\r\ncould not have been sought on the above grounds which were pressed into\r\nservice. In another case law\r\nreported in 1990 SCMR 1630, it has been held by the \u003cspan class=SpellE\u003ehonourable\u003c/span\u003e\r\nSupreme Court of Pakistan that the plaint cannot be rejected on plea of lack of\r\nproof, weakness of proof and only averments of plaint be seen.\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003cspan style=\u0027letter-spacing:.2pt\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003cspan style=\u0027letter-spacing:.2pt\u0027\u003eHowever,\r\nthe plaint cannot be rejected where the pleas raised in the plaint require\r\nevidence such as fraud, misrepresentation, limitation, etc, or any mixed\r\nquestions of law and facts. We would not like to express our views on\r\nthe merits of the respective case of parties. However, it will suffice to\r\nobserve that for the purpose of an application under Order VII, Rule 11,\r\nC.P.C., the averments contained in a plaint are to be presumed, to be correct. Moreover, the order\r\nrejecting a plaint is certainly a decree in terms of the definition of the\r\nexpression \u0026quot;decree\u0026quot; contained in S.2(2), C.P.C. and could be\r\nchallenged under section 96, C.P.C.
