India has already made it\r\npublic to use the entire capacity. Which means this will result in interfering\r\nwith the entire flow of the river for about six months in a year. Besides, it\r\nwill adversely affect the flow of the river to Pakistan at Nausery for\r\noperation of the Neelam-Jhelum plant. The Court considers that while this\r\narbitration is pending, and subject to any agreement between the Parties as to\r\nthe implementation of the present Order, India may: (i) erect temporary\r\ncofferdams and operate the by-pass tunnel it has said to have completed; (ii)\r\ntemporarily dry out the riverbed of the Kishenganga/Neelum at the Gurez valley;\r\n(iii) excavate the riverbed; and (iv) proceed with the construction of the\r\nsub-surface foundations of the dam. However, as specified above, until the\r\nCourt renders its Award, India may not construct any other permanent works on\r\nor above the riverbed that may inhibit the restoration of the full flow of that\r\nriver to its natural channel.\u0026quot;\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltK style=\u0027margin-bottom:4.0pt\u0027\u003e\u003cspan style=\u0027font-size:11.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003e8.\u003cspan style=\u0027mso-tab-count:1\u0027\u003e     \u003c/span\u003eOf\r\ncourse the Court did not grant full relief to Pakistan keeping in view the\r\nTreaty of 1960 and while observing in para.142 and 143 as follows:\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltB style=\u0027margin-bottom:4.0pt\u0027\u003e\u003cspan style=\u0027font-size:11.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003e\u0026quot;142. In the Court\u0027s view, the suspension\r\nof many of the key components of construction activity of the KHEP, such as the\r\nboring of tunnels and the construction of the power house, does not appear to\r\nbe \u0026quot;necessary\u0026quot; to safeguard its ability to render an effective Award.\r\nAs seen during the Court\u0027s site visit, the construction and completion of these\r\nelements of the KHEP occur at some distance from the Kishenganga/Neelum\r\nriverbed, and would thus not in and of themselves affect the flow of the river.\r\nThus, even under the hypothesis that the Court finds at the merits stage that\r\nPakistan\u0027s claims, or elements of those claims, are meritorious and the KHEP\r\ncannot be completed and put into operation as planned, no violations of\r\nPakistan\u0027s rights would have been caused by the tunneling and power house construction\r\naspects of the KHEP, and no particular remedies seem to be available from the\r\nCourt in this regard (at least as far as the Court can see at this early phase\r\nin the proceedings).\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltB style=\u0027margin-bottom:4.0pt\u0027\u003e\u003cspan style=\u0027font-size:11.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003e143. In the Court\u0027s view, the continuation of\r\nsuch activity is appropriately governed by the \u0026quot;proceed at own risk\u0026quot;\r\nprinciple of international law, as specifically recognized by India during the\r\nhearing. The situation would merely be one in which India would have invested\r\nconsiderable sums of money without reaping the benefit of the operation of the\r\nKHEP as currently envisaged. This, however, is precisely the risk that India\r\nhas declared it is willing to assume, and there seems to be no further \u003c/span\u003e\u003cb\u003e\u003ci\u003e\u003cspan\r\nstyle=\u0027font-size:8.0pt;font-family:\"Bookman Old Style\";mso-bidi-font-family:\r\n\"Bookman Old Style\";color:#FF6600\u0027\u003e(Cit. p.145) \u003c/span\u003e\u003c/i\u003e\u003c/b\u003e\u003cspan\r\nstyle=\u0027font-size:11.0pt;font-family:\"Times New Roman\"\u0027\u003erisk of \u0026quot;prejudice\r\nto the final solution,\u0026quot; in terms of the Court\u0027s Award, in allowing these\r\naspects of the KHEP\u0027s construction works to proceed.\u0026quot;\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltK\u003e\u003cspan style=\u0027font-size:11.0pt;font-family:\"Times New Roman\"\u0027\u003e9.\u003cspan\r\nstyle=\u0027mso-tab-count:1\u0027\u003e     \u003c/span\u003eObviously this observation does not give a \u003ci\u003ecarte\r\nblanche\u003c/i\u003e to India but allows it to proceed on: \u0026quot;proceed at own\r\nrisk\u0026quot; basis which will of course be without prejudice to the ultimate\r\ndecision and the principle of \u0026quot;pendente lite\u0026quot;. In this connection the\r\nCourt followed the precedents set in cases: (i) Pulp Mills on the River Uruguay\r\n(Argentina V. Uruguay), ICJ Reports 2006, p. 113, and (ii) Aegean Sea\r\nContinental Shelf (Greece v. Turkey), ICJ Reports 1976, p. 3, at p. 16.\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltK\u003e\u003cspan style=\u0027font-size:11.0pt;font-family:\"Times New Roman\"\u0027\u003e10.\u003cspan\r\nstyle=\u0027mso-tab-count:1\u0027\u003e   \u003c/span\u003eThe good news is that the permanent works\r\nwhich will always interfere in the full flow of the river to its natural\r\nchannel is covered by the interim relief Pakistan got through para. 151 ibid.\r\nThe restriction on permanent construction and the ICA observation in para. 140\r\nof the order said:\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltB\u003e\u003cspan style=\u0027font-size:11.0pt;font-family:\"Times New Roman\"\u0027\u003e\u0026quot;140.\r\nThat said, the Court is satisfied that Pakistan has presented a plausible,\r\nprovisionally tenable argument under the Treaty in support of its case. Having\r\nreviewed Pakistan\u0027s arguments as they are stated in its Memorial, the Court\r\ncannot exclude the possibility that India\u0027s planned installations, or elements\r\nof those installations, on the Kishenganga/Neelum would not be in conformity\r\nwith the Treaty.\u0026quot;\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltK\u003e\u003cspan style=\u0027font-size:11.0pt;font-family:\"Times New Roman\"\u0027\u003e\u003cspan\r\nstyle=\u0027mso-tab-count:1\u0027\u003e       \u003c/span\u003eWhich makes it clear that Pakistan has a\r\ncase and the interpretation of the relevant provision of the Treaty was a need\r\nfor resolving the dispute through arbitration. The final results will of course\r\ndepend on how Pakistan later handles its case based on facts, the intentions of\r\nthe makers of the 1960 Treaty, the International Law of Treaties and the\r\nCustomary International Law.
