At one time the\r\ngrant of anticipatory bail was completely unknown in the Sub-Continent, in as\r\nmuch as no case was then found even in the English Law where anticipatory bail\r\nmight have been allowed. When such a relief was claimed for the first time in\r\nLahore High Court in 1948 the Crown Counsel maintained that the Court did not\r\nenjoy the power to grant bail before arrest.\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltB style=\u0027margin-bottom:10.0pt\u0027\u003e\u003cb\u003e\u003cspan style=\u0027font-size:11.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003e(1)\u003cspan style=\u0027mso-tab-count:1\u0027\u003e \u003c/span\u003ePOSITION\r\nIN INDIA\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/b\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltK style=\u0027margin-bottom:10.0pt\u0027\u003e\u003cspan style=\u0027font-size:11.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003e\u003cspan style=\u0027mso-tab-count:1\u0027\u003e \u003c/span\u003eAs\r\nobserved in Balchand Jain v. State AIR 1977 SC 366, there \u003c/span\u003e\u003cb\u003e\u003ci\u003e\u003cspan\r\nstyle=\u0027font-size:8.0pt;font-family:\"Bookman Old Style\";mso-bidi-font-family:\r\n\"Bookman Old Style\";color:#FF6600\u0027\u003e(Cit. p.132) \u003c/span\u003e\u003c/i\u003e\u003c/b\u003e\u003cspan\r\nstyle=\u0027font-size:11.0pt;font-family:\"Times New Roman\"\u0027\u003ewas at one time conflict\r\nof decisions amongst different High Courts in India about the power of a Court\r\nto grant anticipatory bail. The majority view was that there was no such power\r\nin the Court under the old Criminal Procedure Code (India revised Cr.P.C. 1898\r\nin the year 1974). In the revised Cr.P.C., on the recommendations of the Law\r\nCommission, a new section 438 has been introduced conferring power of\r\nanticipatory bail on High Court and Court of Session.\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltB style=\u0027margin-bottom:10.0pt\u0027\u003e\u003cb\u003e\u003cspan style=\u0027font-size:11.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003e(2)\u003cspan style=\u0027mso-tab-count:1\u0027\u003e \u003c/span\u003ePOSITION\r\nIN PAKISTAN \u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/b\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltK style=\u0027margin-bottom:10.0pt\u0027\u003e\u003cspan style=\u0027font-size:11.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003e\u003cspan style=\u0027mso-tab-count:1\u0027\u003e \u003c/span\u003eIn\r\nPakistan also there was an impression at one time that Cr.P.C. is completely\r\nsilent about the power of the Courts to grant anticipatory bail. It is,\r\nhowever, now well settled that Section 498, Cr.P.C. deals with such powers of\r\nHigh Court and Court of Session. Unlike India the law of anticipatory bail in\r\nPakistan is not statutory law, rather Judge made law based on interpretation of\r\nthe provisions of section 498, Cr.P.C. The Crown Counsel challenged the competence\r\nof High Court to grant bail in anticipation of arrest. The matter being\r\n\u0026quot;important\u0026quot; involving \u0026quot;difficult\u0026quot; question of \u003c/span\u003e\u003cb\u003e\u003ci\u003e\u003cspan\r\nstyle=\u0027font-size:8.0pt;font-family:\"Bookman Old Style\";mso-bidi-font-family:\r\n\"Bookman Old Style\";color:#FF6600\u0027\u003e(Cit. p.133) \u003c/span\u003e\u003c/i\u003e\u003c/b\u003e\u003cspan\r\nstyle=\u0027font-size:11.0pt;font-family:\"Times New Roman\"\u0027\u003elaw a Full Bench headed\r\nby Mr. Justice Muhammad Munir Actg. Chief Justice was constituted. The order was based on the authority of Hidayatullah\r\nKhan\u0027s case in preference to Full Bench case of East Punjab, Amirchand v. Crown\r\nAIR 1950, East Punjab 53 and Muhammad Abbas v. and the Police and enables these Courts to\r\nexercise the power of anticipatory bail, in suitable cases.\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltK style=\u0027margin-bottom:10.0pt\u0027\u003e\u003cspan style=\u0027font-size:11.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003e(4)\u003cspan style=\u0027mso-tab-count:1\u0027\u003e \u003c/span\u003eIt\r\nwould be seen that the Supreme Court of Pakistan in its above judgment has\r\nclearly specified the circumstances and the parameters under and within which\r\npost arrest bail and bail before arrest can be granted. It is thus requirement\r\nof law that while dealing with bail matters \u003c/span\u003e\u003cb\u003e\u003ci\u003e\u003cspan\r\nstyle=\u0027font-size:8.0pt;font-family:\"Bookman Old Style\";mso-bidi-font-family:\r\n\"Bookman Old Style\";color:#FF6600\u0027\u003e(Cit. p.137) \u003c/span\u003e\u003c/i\u003e\u003c/b\u003e\u003cspan\r\nstyle=\u0027font-size:11.0pt;font-family:\"Times New Roman\"\u0027\u003eone must fully comply\r\nwith the same, ensuring that there is no deviation therefrom. These have to be\r\nnecessarily followed in their letter and spirit.\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltK style=\u0027margin-bottom:10.0pt\u0027\u003e\u003cspan style=\u0027font-size:11.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003e(5)\u003cspan style=\u0027mso-tab-count:1\u0027\u003e \u003c/span\u003eThe\r\nquestions raised above are now answered seriatim in the light of the judgment\r\ngiven in Muhammad Ayub\u0027s case and other judgments of Superior Courts:--\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltB style=\u0027margin-bottom:10.0pt\u0027\u003e\u003cspan style=\u0027font-size:11.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003e(a)\u003cspan style=\u0027mso-tab-count:1\u0027\u003e \u003c/span\u003eIn\r\nthe case of surrender before the Magistrate the accused puts up his\r\n\u0026quot;voluntary appearance\u0026quot; and does not appear in response to any process\r\nissued to him. Moreover, neither at that time the accused is under actual\r\narrest so as to attract the jurisdiction of the Magistrate nor the latter is\r\ndirectly seized of the proceedings in\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003ewhich\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003ethe\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003ebail\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003eis\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003erequested.\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003eAll\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003ethese\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003eare\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003econditions precedent\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003efor\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003ethe\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003egrant\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003eof\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003ebail\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003eunder\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003ethe\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003eprovisions\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003eof sections 496 and\r\n497, leading to a safe inference that the grant of bail by the Magistrate in\r\nthe case of surrender is without jurisdiction.\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltB style=\u0027margin-bottom:10.0pt\u0027\u003e\u003cspan style=\u0027font-size:11.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003e(b)\u003cspan style=\u0027mso-tab-count:1\u0027\u003e \u003c/span\u003e\u0026quot;Voluntary\r\nappearance\u0026quot; is permissible only under section 498, Cr.P.C. the\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003eproper\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003eforum\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003efor\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003ewhich\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003eis\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003eHigh\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003eCourt\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003eor Court\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003eof\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003eSession\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003eand\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003enot\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003ethe\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003eMagistrate; still\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003eif\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003ehe\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003egrants bail\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003ein\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003esuch\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003ea\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003ecase\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003eit\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003ewould\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003eamount\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003eto\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003egrant of bail before arrest.\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltB style=\u0027margin-bottom:10.0pt\u0027\u003e\u003cspan style=\u0027font-size:11.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003e(c)\u003cspan style=\u0027mso-tab-count:1\u0027\u003e \u003c/span\u003eThe\r\ngrant of bail in such a case would also result in defeating the statutory right\r\nof investigation of police. The Supreme Court in State v. Fateh Muhammad 1972\r\nSCMR 182 observed that the statutory right of police to investigate a\r\ncognizable offence cannot be circumvented by the accused by avoiding police and\r\nsurrendering before a Magistrate.\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltB style=\u0027margin-bottom:10.0pt\u0027\u003e\u003cspan style=\u0027font-size:11.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003e(d)\u003cspan style=\u0027mso-tab-count:1\u0027\u003e \u003c/span\u003eThe\r\nconnotation of \u0026quot;judicial custody\u0026quot; has been elaborated in State v.\r\nMuhammad Ayoob PLD 2008 Karachi 492. The Court observed as under:--\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltB style=\u0027margin-bottom:10.0pt\u0027\u003e\u003cspan style=\u0027font-size:11.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003e\u003cspan style=\u0027mso-tab-count:1\u0027\u003e \u003c/span\u003e\u0026quot;There\r\nis no scope for a person to contend that his voluntarily appearance before the\r\nCourt should be construed as \u0026quot;judicial custody\u0026quot;. The concept of\r\n\u0026quot;custody\u0026quot; as enunciated in the Crown v. Khushi Muhammad PLD 1953 FC\r\n170 connotes that the person is under some actual restraint. In other words,\r\nthere is no concept of constructive custody before the court or a Judge by way\r\nof a voluntary surrender. To further make out this point, reference is invited\r\nto Jumma Khan v. The State PLD 1960 Pesh. 25 wherein it was held that the\r\nappearance before the Court mentioned in section 497 of the Cr.P.C. is\r\nappearance in \u003c/span\u003e\u003cb\u003e\u003ci\u003e\u003cspan style=\u0027font-size:8.0pt;font-family:\"Bookman Old Style\";\r\nmso-bidi-font-family:\"Bookman Old Style\";color:#FF6600\u0027\u003e(Cit. p.138) \u003c/span\u003e\u003c/i\u003e\u003c/b\u003e\u003cspan\r\nstyle=\u0027font-size:11.0pt;font-family:\"Times New Roman\"\u0027\u003ecompliance with a\r\nprocess issued by a Court. It was further observed that where no process for\r\nthe appearance of an accused person is issued by any Court and he voluntarily\r\nmakes appearance, he is neither under any form of restraint nor has he any process\r\nfor his restraint. Although the judgments in The Crown v. Khushi Muhammad and\r\nJumma Khan v. The State were delivered at the time when the concept of bail\r\nbefore arrest was till its embryonic state in Pakistan, the said two judgments\r\nare still good authority for the proposition and to the extent that a voluntary\r\nsurrender per se before the Court of law cannot be construed as\r\n\u0026quot;custody\u0026quot;.\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltB style=\u0027margin-bottom:10.0pt\u0027\u003e\u003cspan style=\u0027font-size:11.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003e(6)\u003cspan style=\u0027mso-tab-count:1\u0027\u003e \u003c/span\u003e\u003cb\u003eBAIL\r\nGRANTING POWERS OF A MAGISTRATE\u003c/b\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltK style=\u0027margin-bottom:10.0pt\u0027\u003e\u003cspan style=\u0027font-size:11.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003e\u003cspan style=\u0027mso-tab-count:1\u0027\u003e \u003c/span\u003eIt\r\nhas been seen that a Magistrate is not competent to grant bail before arrest.\r\nHe can grant bail either to a person in actual custody or to the one who\r\nappears before him in response to process issued against him.\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltK style=\u0027margin-bottom:10.0pt\u0027\u003e\u003cspan style=\u0027font-size:11.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003e\u003cspan style=\u0027mso-tab-count:1\u0027\u003e \u003c/span\u003eThere\r\nare, however, two rulings of Lahore High Court pronounced by Mr. Justice\r\nMuhammad Afzal Zullah whereby the Magistrate\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003ehas\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003ebeen\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003eheld\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003eto\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003ebe\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003eempowered\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003eto\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003egrant\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003ebail\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003ebefore arrest,\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003ewhen\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003ethe\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003eaccused\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003ehad\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003esurrendered\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003ehimself\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003ebefore\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003ethe\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003eCourt.\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltK style=\u0027margin-bottom:10.0pt\u0027\u003e\u003cspan style=\u0027font-size:11.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003e\u003cspan style=\u0027mso-tab-count:1\u0027\u003e \u003c/span\u003eThe\r\nfirst case is Muhammad Sharif v. State PLJ 1978 Criminal Case Lahore 553=1979\r\nPCr.LJ Note 7 at page 5. In this case the petitioner sought bail before arrest\r\ndirectly from the Lahore High Court which was disallowed with the observations\r\nthat even the Magistrate had ample jurisdiction to admit a person to bail\r\nbefore arrest. It was observed as follows:--\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltB\u003e\u003cspan style=\u0027font-size:11.0pt;font-family:\"Times New Roman\"\u0027\u003e\u003cspan\r\nstyle=\u0027mso-tab-count:1\u0027\u003e \u003c/span\u003e\u0026quot;2. Learned counsel states that the\r\npetitioner cannot move for bail before arrest before a Magistrate. In so for as\r\nthe technical phraseology \u0026quot;bail before arrest\u0026quot; used in some rulings\r\nis concerned, this might, on face, appear to be correct; but the provisions contained\r\nin subsection (1) of section 497, Cr.P.C. permit an accused person to appear\r\nbefore a Court of Magistrate even prior to his physical arrest and thus after\r\npresenting himself before the Court seek bail under subsection (1) of section\r\n497. In this case the\r\nMagistrate, acting on Muhammad Sharif\u0027s case admitted the accused persons to\r\nbail even though they had not been formally \u003c/span\u003e\u003cb\u003e\u003ci\u003e\u003cspan\r\nstyle=\u0027font-size:8.0pt;font-family:\"Bookman Old Style\";mso-bidi-font-family:\r\n\"Bookman Old Style\";color:#FF6600\u0027\u003e(Cit. p.139) \u003c/span\u003e\u003c/i\u003e\u003c/b\u003e\u003cspan\r\nstyle=\u0027font-size:11.0pt;font-family:\"Times New Roman\"\u0027\u003earrested. The counsel\r\nfor the complainant relying on Muhammad Ayub\u0027s case\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003econtended\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003ethat\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003ethe\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003elaw\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003elaid\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003edown\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003ein\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003ethe\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003ecase\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003eof\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003eMuhammad Sharif\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003eis\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003enot\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003ecorrect;\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003ebecause\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003eanticipatory\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003ebail\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003ecannot\u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003ebe\u003cspan style=\u0027mso-spacerun:yes\u0027\u003e \r\n\u003c/span\u003eallowed by a Magistrate under section 497, Cr.P.C.---such power is\r\navailable only with the Sessions Court and the High Court under section 498,\r\nCr.P.C.\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltK style=\u0027margin-bottom:9.0pt\u0027\u003e\u003cspan style=\u0027font-size:11.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003e\u003cspan style=\u0027mso-tab-count:1\u0027\u003e \u003c/span\u003eIt\r\nwas, however, again held that the observations made in Muhammad Sharif\u0027s case\r\nis not contrary to law. In the first category bail could only be granted if the person was in\r\nactual custody; the second category deals with a situation when a person\r\nappears in answer to a process issued by the Court and in the third category\r\neither the police or some other law enforcing agency brings a person before the\r\nMagistrate. No other category of person is within the scope of the provisions\r\nof these two sections. As observed in PLD 2008 Karachi 492 a person who makes\r\nvoluntary appearance is neither under any custody nor under any restraint and\r\nhis voluntary appearance per se before the Court of law cannot be construed as\r\n\u0026quot;custody\u0026quot;. Such a person is not entitled to claim bail under these\r\nsections.
