as part of\r\nits Doing Business Report for number of economies. It s recent Doing Business\r\nReport 2010 issued in June, 2010, for Pakistan has, among number of things,\r\nhighlighted contract enforcement issues in 13 cities of Pakistan. For\r\nreference, out of 13 cities, Sukkur in Sindh Province is ranked 1 in contract\r\nenforcement where on average it takes 1,060 days to enforce a contract which\r\ninvolves 47 procedures and cost of contract enforcement is 20.6% of the claimed\r\namount. On the other hand, Quetta in Balochistan province is ranked 13 where on\r\naverage it takes 1,498 days to enforce a contract which involves 47 procedures\r\nand cost of contract enforcement is 32.4% of the claimed amount. These\r\nindicators reflect delays in contract enforcement and delayed dispensation of\r\njustice. With these methods of ADR in use, pendency of cases in courts\r\nmay also be reduced which will allow courts focus on more important and\r\nintricate matters. However, section 89-A is generally opposed by the parties as\r\nresolving disputes through ADR is considered to be a weakness by litigants and\r\nADR is also not preferred by litigants who file frivolous or vexatious claims.\r\nThere are also many misconceptions about mediation as legal counsel fear that\r\ntheir professional fee may be reduced if disputes are resolved quickly. Also, an Accreditation\r\nProgram in Mediation at National level is missing. Although with efforts of\r\nIFC, private sector arm of the World Bank Group, Karachi Centre for Dispute\r\nResolution (KCDR) has been established as Pakistan s first ADR and mediation\r\ncentre. KCDR has foreign accredited mediators trained through IFC consultants\r\nwho provide mediation services when called to do so by KCDR. KCDR mediators\r\nassist parties to resolve disputes and these cases are referred by Sindh High\r\nCourt and its subordinate courts. Parties can also refer cases to KCDR for\r\namicable dispute resolution. KCDR has also been providing training to\r\nprofessionals in Conflict Resolution, ADR and mediation. A number of jurisdictions in\r\nCommonwealth have developed laws on mediation, for example, Sri Lanka and\r\nTrinidad and Tobago. Afghanistan have promulgated a Presidential Decree on\r\nMediation which highlights its interest in complementing efforts of judiciary\r\nin reducing pendency of cases in courts which have been affected by war for a\r\nlong time.\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltB\u003e\u003cspan style=\u0027font-size:11.0pt;font-family:\"Times New Roman\"\u0027\u003e2.\u003cspan\r\nstyle=\u0027mso-tab-count:1\u0027\u003e \u003c/span\u003e\u003cu\u003eEstablishment of Mediation Centres\u003c/u\u003e.--\r\nThere is a strong business and market need for establishing mediation centres\r\nin Pakistan to which disputes may be referred. Although Chamber of Commerce and\r\nBusiness Associations generally have an ADR or Arbitration Committees\r\nestablished to facilitate amicable settlement of disputes among its members (or\r\nother parties), independent mediation centres can be more successful in\r\nattracting disputants for the reason that parties may wish to refer their\r\ndispute to a neutral entity where all disputants receive equal treatment.\u003cb\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/b\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltB style=\u0027margin-bottom:6.0pt\u0027\u003e\u003cspan style=\u0027font-size:11.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003e3.\u003cspan style=\u0027mso-tab-count:1\u0027\u003e \u003c/span\u003e\u003cu\u003eEstablishment\r\nof Court-Annexed ADR Centres\u003c/u\u003e\u003cb\u003e.--\u003c/b\u003e In India and other jurisdictions,\r\ncourt-annexed ADR and mediation centres have been established largely due to\r\nstrategic vision of the Judiciary in enhancing access to justice, reducing case\r\npendency and providing mechanisms that can reduce time and cost of dispute\r\nresolution. It is proposed that Ministry of Law and Justice and apex Judiciary\r\nset up Court-Annexed ADR Centres at High Courts and/or District Courts. \u003cb\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/b\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=AltB style=\u0027margin-bottom:6.0pt\u0027\u003e\u003cspan style=\u0027font-size:11.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003e4.\u003cspan style=\u0027mso-tab-count:1\u0027\u003e \u003c/span\u003e\u003cu\u003eNational\r\nAccreditation Program in ADR\u003c/u\u003e\u003cb\u003e.--\u003c/b\u003e For building capacity of\r\nprofessionals in mediation, a National Accreditation Program in ADR is\r\nrequired. With Accredited Mediators, courts and parties will be able to rely on\r\nskills of Mediators who are qualified and have experience in art of mediation\r\nand assist parties in settlement of their disputes. Either a separate\r\ninstitution or Pakistan Bar Council may be involved in the National\r\nAccreditation Program in ADR. It is proposed and desired that Pakistan Bar\r\nCouncil and its provincial counterparts and Supreme Court Bar Association and\r\nits related Bar Associations in High Courts and District Courts introduce\r\nmediation training for their members. Federal and\r\nProvincial Judicial academies in Pakistan are already working in this area and\r\ndo hold lectures on ADR. The legal\r\nprofession has to accept business and market needs and equip themselves with\r\nknowledge and skills of mediation and develop professional capacity in field of\r\nADR as this is a major requirement for modern day clients. ADR was given importance\r\nin Agenda of the Conference and speakers at an ADR session discussed ADR, its\r\nbenefits, problems and future development including recommendations. During\r\nsame month, IFC in collaboration with Federal Judicial Academy, Islamabad and\r\nEmbassy of the Kingdom of the Netherlands organized a 2- day National\r\nConference on ADR in Lahore which provided opportunity for members of\r\nJudiciary, Legal profession, Government, Academia and others to highlight\r\nchallenges and developments in ADR in Pakistan and future interventions\r\nrequired.
