place laws protecting children in contact or\r\nin conflict with the law. There are still around 1500 children held in prisons,\r\nmost without conviction, awaiting lengthy court cases and possible harsh\r\npunishments. The Pakistan Penal Code set the age of criminality at seven which\r\nmeant that young children could be detained in harsh\u0027 circumstances. The\r\nGovernment promulgated the Juvenile Justice System Ordinance (JJSO) in 2000, which\r\ntried to bring the law on juvenile justice in conformity with international\r\nstandards by defining the child as under 18; prohibiting the use of hand-cuffs;\r\nbanning capital punishment; and making provisions for the establishment of\r\nexclusive juvenile courts. However, there have been gaps in the implementation\r\nof the JJSO. The Juvenile Justice System continues to be weak in the country.\r\nThe government did not establish separate and exclusive juvenile courts, but\r\ndesignated all Magistrates and Sessions Judges to perform as juvenile courts.\r\nThe probation department is weak and except for Punjab and Khyber Pakhtunkhwa,\r\nthe other provincial probation departments do not even have female probation\r\nofficers, hence female children are put under the supervision of male probation\r\nofficers.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify;mso-pagination:none;mso-layout-grid-align:\r\nnone;text-autospace:none\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify;mso-pagination:none;mso-layout-grid-align:\r\nnone;text-autospace:none\u0027\u003eFor children who are convicted under the law there\r\nare only two borstal homes .in the Punjab and one reformatory school in Sindh.\r\nKhyber Pakhtunkhawa and Balochistan have no borstal homes or reformatory\r\nschools, and children continue to be incarcerated in adult jails. There is\r\nneither an institutionalized data collection and reporting system on children\r\nin conflict with law nor any functional complaint mechanism. Proper data of juvenile\r\noffenders is not available at police station level as there is no system to\r\nmaintain records and information which would be used for extending them\r\nassistance. Police officers who deal with juveniles are not specially\r\ninstructed and trained. It is usually reported in print media about abuse of\r\nchild at police station during the course of investigation. The cases of the\r\njuvenile are not disposed of within the time prescribed under the law. They are\r\nbrought in the same police stations where adult are detained and interrogated.\r\nThere is dire need to set up special unit at district level for handling\r\njuvenile, and trained staff/officers need to be appointed (designated) therein.\r\nAn attempt was made by the Islamabad Police in this regard and an agreement was\r\nexecuted to implement the scheme. The practice is being replicated in Sindh\r\nwith more initiatives and objectives. Setting up child friendly place of\r\ninvestigation, maintenance of juvenile record, offender-victim mediation, and\r\ndiversion for the rehabilitation would definitely facilitate juvenile\r\noffenders.
