The said\r\n\u003c/span\u003e\u003cspan style=\u0027letter-spacing:.85pt\u0027\u003edefinition provides in relevant part\r\nthat international \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.35pt\u0027\u003ecommercial\r\narbitration includes an arbitration relating to \u003c/span\u003e\u003cspan style=\u0027letter-spacing:\r\n-.05pt\u0027\u003ecertain disputes [Emphasis added]. The use of the term \u0027certain\u0027 \u003c/span\u003e\u003cspan\r\nstyle=\u0027letter-spacing:.3pt\u0027\u003egives an impression of restricting the scope of\r\ndisputes that \u003c/span\u003e\u003cspan style=\u0027letter-spacing:-.1pt\u0027\u003emay be subject of an\r\ninternational commercial arbitration. This \u003c/span\u003e\u003cspan style=\u0027letter-spacing:\r\n.45pt\u0027\u003ecoupled with the qualification that only those commercial \u003c/span\u003e\u003cspan\r\nstyle=\u0027letter-spacing:.2pt\u0027\u003edisputes shall be resolved through international\r\ncommercial \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.15pt\u0027\u003earbitration which are\r\nconsidered as commercial under the law \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.2pt\u0027\u003ein\r\nforce in Pakistan will further restrict the scope of disputes \u003c/span\u003e\u003cspan\r\nstyle=\u0027letter-spacing:.75pt\u0027\u003ethat can be resolved through international\r\ncommercial \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.55pt\u0027\u003earbitration\u003csup\u003e1\u003c/sup\u003e.\r\nIt is suggested that the term \u0027certain\u0027 in the \u003c/span\u003e\u003cspan style=\u0027letter-spacing:\r\n.05pt\u0027\u003edefinition in section 2(1) (i) should either be deleted or it should \u003c/span\u003e\u003cspan\r\nstyle=\u0027letter-spacing:.1pt\u0027\u003ebe replaced with some other appropriate word such\r\nas \u0027any\u0027. There is \u003c/span\u003e\u003cspan\r\nstyle=\u0027font-size:12.0pt;font-family:\"Times New Roman\";letter-spacing:.3pt\u0027\u003eabundant\r\ncase-law in arbitration practice worldwide which hovers around the issue\r\nwhether a person is a party to the \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003earbitration agreement or not. The issue\r\nfrequently comes up in \u003cspan style=\u0027letter-spacing:.35pt\u0027\u003ecases where\r\narbitration agreement has been signed by, for \u003c/span\u003e\u003cspan style=\u0027letter-spacing:\r\n.15pt\u0027\u003einstance, a parent company, whereas, the performance under \u003c/span\u003ethe\r\ncontract has to be carried out by one of its subsidiary or a \u003cspan\r\nstyle=\u0027letter-spacing:.15pt\u0027\u003especial purpose vehicle. In case a claim is\r\nbrought against a \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.3pt\u0027\u003esubsidiary company\r\nin arbitration, the issue whether such subsidiary company is a party to the\r\narbitration agreement \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.25pt\u0027\u003esprings up\r\nbefore the Tribunal. The case-law has laid down \u003c/span\u003e\u003cspan style=\u0027letter-spacing:\r\n.1pt\u0027\u003evarious doctrines such as incorporation by reference, alter ego \u003c/span\u003e\u003cspan\r\nstyle=\u0027letter-spacing:.05pt\u0027\u003eetc. to answer the question whether a person is a\r\nparty to the \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.4pt\u0027\u003earbitration agreement, or\r\nnot. It has been observed that by \u003c/span\u003e\u003cspan style=\u0027letter-spacing:-.05pt\u0027\u003eproviding\r\nthe definition of the term \u0027party\u0027 in section 2(1) (k), the \u003c/span\u003e\u003cspan\r\nstyle=\u0027letter-spacing:-.1pt\u0027\u003escope of the, persons that may bring or\r\nparticipate in arbitration \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.2pt\u0027\u003eproceeding\r\nwill be considerably curtailed as according to the said definition only party\r\nto an arbitration agreement comes \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.5pt\u0027\u003e_within\r\nthe purview of the Arbitration Bill. Even if it is assumed\r\nfor the sake of argument that the term \u0027place of business\u0027 can cater to the\r\ncircumstances where service is to be effected on a body \u003cspan style=\u0027letter-spacing:\r\n.25pt\u0027\u003ecorporate/company, it is unclear whether the term \u0027place of \u003c/span\u003e\u003cspan\r\nstyle=\u0027letter-spacing:.05pt\u0027\u003ebusiness\u0027 would refer to the registered address of\r\na company or \u003c/span\u003e\u003cspan style=\u0027letter-spacing:-.1pt\u0027\u003ethe address of its place\r\nof business. It may be noted that proper \u003c/span\u003e\u003cspan style=\u0027letter-spacing:\r\n.1pt\u0027\u003eservice of a notice/written communication is considered as one \u003c/span\u003eof\r\nthe fundamental principles of procedural fairness. Improper \u003cspan\r\nstyle=\u0027letter-spacing:.25pt\u0027\u003eservice has far reaching consequences including\r\nthe setting \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.4pt\u0027\u003easide of an award. It is\r\ntherefore suggested that section 3 \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.35pt\u0027\u003eshould\r\nbe rephrased to include a specific provision for the \u003c/span\u003e\u003cspan\r\nstyle=\u0027letter-spacing:.25pt\u0027\u003eservice of notice on a body corporate/company.\r\nReference in \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.35pt\u0027\u003ethis regard may kindly\r\nbe made to section 76(4) (b)\u003csup\u003e2\u003c/sup\u003e of the \u003c/span\u003e\u003cspan style=\u0027letter-spacing:\r\n.2pt\u0027\u003eEnglish Arbitration Act, 1996 (hereinafter \u0026quot;English Act\u0026quot;) that \u003c/span\u003edeals\r\nwith the service of notice on a body corporate.\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027margin-bottom:0in;margin-bottom:.0001pt;text-align:\r\njustify;line-height:normal;mso-pagination:none;mso-layout-grid-align:none;\r\ntext-autospace:none\u0027\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\"Times New Roman\";\r\nletter-spacing:.1pt\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027margin-bottom:0in;margin-bottom:.0001pt;text-align:\r\njustify;line-height:normal;mso-pagination:none;mso-layout-grid-align:none;\r\ntext-autospace:none\u0027\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\"Times New Roman\";\r\nletter-spacing:.1pt\u0027\u003eSection 4 deals with the waiver of the right to object to \u003c/span\u003e\u003cspan\r\nstyle=\u0027font-size:12.0pt;font-family:\"Times New Roman\";letter-spacing:.2pt\u0027\u003eany\r\nomission by the other party. Waiver under section 4 will \u003c/span\u003e\u003cspan\r\nstyle=\u0027font-size:12.0pt;font-family:\"Times New Roman\";letter-spacing:.55pt\u0027\u003ecome\r\ninto operation where a party who knows [Emphasis \u003c/span\u003e\u003cspan style=\u0027font-size:\r\n12.0pt;font-family:\"Times New Roman\";letter-spacing:.05pt\u0027\u003eadded] of the\r\nomission as provided therein proceeds with\u003csup\u003e-\u003c/sup\u003e the arbitration without\r\nstating his objections. By corollary, a party \u003c/span\u003e\u003cspan style=\u0027font-size:\r\n12.0pt;font-family:\"Times New Roman\";letter-spacing:.25pt\u0027\u003ewho does not know\r\nwould not be deemed to have waived his \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;\r\nfont-family:\"Times New Roman\";letter-spacing:.1pt\u0027\u003eright to object. Knowledge\r\nof a person refers to his subjective intention that cannot be judged by someone\r\nelse. The changes \u003c/span\u003e\u003cspan\r\nstyle=\u0027font-size:12.0pt;font-family:\"Times New Roman\";letter-spacing:.2pt\u0027\u003eto\r\nUNCITRAL Model Law have been adopted by the UNCITRAL \u003c/span\u003e\u003cspan\r\nstyle=\u0027font-size:12.0pt;font-family:\"Times New Roman\";letter-spacing:.7pt\u0027\u003eat\r\nits thirty-ninth session in 2006. It is suggested that \u003c/span\u003e\u003cspan\r\nstyle=\u0027font-size:12.0pt;font-family:\"Times New Roman\";letter-spacing:.8pt\u0027\u003esection\r\n7 in the Arbitration Bill should be amended to \u003c/span\u003e\u003cspan style=\u0027font-size:\r\n12.0pt;font-family:\"Times New Roman\";letter-spacing:-.05pt\u0027\u003ebring it at par with\r\nthe revised section 7 of the UNCITRAL Model \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003eLaw.\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027margin-bottom:0in;margin-bottom:.0001pt;text-align:\r\njustify;line-height:normal;mso-pagination:none;mso-layout-grid-align:none;\r\ntext-autospace:none\u0027\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\"Times New Roman\";\r\nletter-spacing:.55pt\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027margin-bottom:0in;margin-bottom:.0001pt;text-align:\r\njustify;line-height:normal;mso-pagination:none;mso-layout-grid-align:none;\r\ntext-autospace:none\u0027\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\"Times New Roman\";\r\nletter-spacing:.55pt\u0027\u003eOne of the striking subsections in section 7 is the \u003c/span\u003e\u003cspan\r\nstyle=\u0027font-size:12.0pt;font-family:\"Times New Roman\";letter-spacing:.6pt\u0027\u003edeeming\r\nsubsection (5), which by its terms incorporates \u003c/span\u003e\u003cspan style=\u0027font-size:\r\n12.0pt;font-family:\"Times New Roman\";letter-spacing:-.05pt\u0027\u003earbitration\r\nagreement in every commercial contract. It is a novel \u003c/span\u003e\u003cspan\r\nstyle=\u0027font-size:12.0pt;font-family:\"Times New Roman\"\u0027\u003ething that is not\r\npresent in any legal system in the world. This \u003cspan style=\u0027letter-spacing:\r\n.75pt\u0027\u003esubsection per se will be unable to withstand the legal \u003c/span\u003e\u003cspan\r\nstyle=\u0027letter-spacing:.3pt\u0027\u003echallenge as it is contrary to whole concept and\r\nideology of \u003c/span\u003earbitration. Arbitration is a consensual process that comes\r\ninto \u003cspan style=\u0027letter-spacing:.65pt\u0027\u003eplay with the agreement of the parties.\r\nThere can be no \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.2pt\u0027\u003earbitration when there\r\nis no agreement between the parties. \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.1pt\u0027\u003eSubsection\r\n(5) is inimical to this basis consensual ideology of \u003c/span\u003e\u003cspan\r\nstyle=\u0027letter-spacing:.55pt\u0027\u003earbitration. Section \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;\r\nfont-family:\"Times New Roman\";letter-spacing:.45pt\u0027\u003e8 is silent as to the\r\nsituation where a plaintiff has \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;\r\nfont-family:\"Times New Roman\";letter-spacing:-.15pt\u0027\u003ebrought an action against\r\nmore than one defendant, and \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\r\n\"Times New Roman\";letter-spacing:.15pt\u0027\u003ethere is an arbitration agreement between\r\nthe plaintiff \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\"Times New Roman\";\r\nletter-spacing:.05pt\u0027\u003eand only one defendant. In \u003c/span\u003e\u003cspan\r\nstyle=\u0027letter-spacing:.1pt\u0027\u003esuch a situation, it would not be possible for that\r\nparty to certify any copy of the arbitration agreement. Even \u003c/span\u003e\u003cspan\r\nstyle=\u0027letter-spacing:.15pt\u0027\u003eotherwise, section 8(2) is oblique to the extent\r\nthat it \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.2pt\u0027\u003eprovides for reliance on a\r\ncertified copy but does not \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.35pt\u0027\u003especify\r\nthe person/authority that has to certify the agreement. Whether certification\r\nby the party itself \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.9pt\u0027\u003ewould suffice? This\r\ncan be enumerated by an example: a \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;\r\nfont-family:\"Times New Roman\";letter-spacing:.55pt\u0027\u003esuit has been instituted by\r\nan employer against a \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\"Times New Roman\";\r\nletter-spacing:-.05pt\u0027\u003econtractor, sub-contractor and the supplier. It is in\r\nthe \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\"Times New Roman\";\r\nletter-spacing:.05pt\u0027\u003einterest of the parties that the matter between them is \u003c/span\u003e\u003cspan\r\nstyle=\u0027font-size:12.0pt;font-family:\"Times New Roman\";letter-spacing:.1pt\u0027\u003eresolved\r\nbefore a single forum. The sub-contractor and \u003c/span\u003e\u003cspan style=\u0027font-size:\r\n12.0pt;font-family:\"Times New Roman\";letter-spacing:.2pt\u0027\u003ethe supplier have a\r\ndispute which is remotely related \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;\r\nfont-family:\"Times New Roman\";letter-spacing:.45pt\u0027\u003ewith the overall dispute\r\nbetween the employer, the \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\r\n\"Times New Roman\";letter-spacing:.1pt\u0027\u003econtractor, sub-contractor and the\r\nsupplier but it is in \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\"Times New Roman\";\r\nletter-spacing:.3pt\u0027\u003ethe interest of the parties that it should be resolved \u003c/span\u003e\u003cspan\r\nstyle=\u0027font-size:12.0pt;font-family:\"Times New Roman\";letter-spacing:.4pt\u0027\u003ealong\r\nwith the overall dispute between the parties. \u003c/span\u003e\u003cspan style=\u0027font-size:\r\n12.0pt;font-family:\"Times New Roman\";letter-spacing:.25pt\u0027\u003eHowever, the\r\nsub-contractor and the supplier resolve \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;\r\nfont-family:\"Times New Roman\";letter-spacing:-.05pt\u0027\u003ethe settle that dispute\r\nthrough arbitration. They apply to the court for referral of their dispute to\r\narbitration. The employer (plaintiff) opposes the application. If the court \u003c/span\u003e\u003cspan\r\nstyle=\u0027font-size:12.0pt;font-family:\"Times New Roman\";letter-spacing:.35pt\u0027\u003eaccepts\r\nthe application, the sub-contractor and the \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;\r\nfont-family:\"Times New Roman\";letter-spacing:.9pt\u0027\u003esupplier will no longer\r\nparticipate in the court \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\"Times New Roman\";\r\nletter-spacing:-.15pt\u0027\u003eproceedings, which will put the employer (plaintiff) in\r\nan \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\"Times New Roman\";\r\nletter-spacing:.15pt\u0027\u003eawkward position who wanted the dispute between all \u003c/span\u003e\u003cspan\r\nstyle=\u0027font-size:12.0pt;font-family:\"Times New Roman\";letter-spacing:.5pt\u0027\u003ethe\r\nparties to be settled in one set of proceedings. \u003c/span\u003e\u003cspan style=\u0027font-size:\r\n12.0pt;font-family:\"Times New Roman\";letter-spacing:-.15pt\u0027\u003eSection 8(7) can\r\nfurther complicate the situation where a \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;\r\nfont-family:\"Times New Roman\";letter-spacing:.05pt\u0027\u003eparty has raised a dispute\r\nwhich it wants to be resolved \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\r\n\"Times New Roman\";letter-spacing:-.1pt\u0027\u003eby the court. That particular dispute\r\nhas also been raised \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\"Times New Roman\";\r\nletter-spacing:.3pt\u0027\u003eby certain other parties. Those certain other parties \u003c/span\u003e\u003cspan\r\nstyle=\u0027font-size:12.0pt;font-family:\"Times New Roman\";letter-spacing:.45pt\u0027\u003edecide\r\nfor the referral of that particular dispute to \u003c/span\u003e\u003cspan style=\u0027font-size:\r\n12.0pt;font-family:\"Times New Roman\";letter-spacing:-.1pt\u0027\u003earbitration but not\r\nthe first party. If the court refers the \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;\r\nfont-family:\"Times New Roman\";letter-spacing:-.05pt\u0027\u003edispute to arbitration, it\r\nwould be contrary to the consent \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;\r\nfont-family:\"Times New Roman\";letter-spacing:-.15pt\u0027\u003eof the first party that is\r\ninimical to the basic consensual \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;\r\nfont-family:\"Times New Roman\";letter-spacing:-.2pt\u0027\u003eideology of arbitration.\r\nTherefore, reference to arbitration \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;\r\nfont-family:\"Times New Roman\";letter-spacing:.2pt\u0027\u003eduring court proceedings is\r\nbest suited where all the \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\r\n\"Times New Roman\"\u0027\u003eparties agree for the referral of the dispute to\r\narbitration.\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027margin-bottom:0in;margin-bottom:.0001pt;text-align:\r\njustify;line-height:normal;mso-pagination:none;mso-layout-grid-align:none;\r\ntext-autospace:none\u0027\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\"Times New Roman\";\r\nletter-spacing:.1pt\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027margin-bottom:0in;margin-bottom:.0001pt;text-align:\r\njustify;line-height:normal;mso-pagination:none;mso-layout-grid-align:none;\r\ntext-autospace:none\u0027\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\"Times New Roman\";\r\nletter-spacing:.1pt\u0027\u003eIn view of the foregoing, it is observed that section 8(7)\r\n\u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\"Times New Roman\"\u0027\u003ewill be\r\nunable to withstand legal challenge. Hence, it is \u003cspan style=\u0027letter-spacing:\r\n.35pt\u0027\u003esuggested that section 8(7) should be omitted in its \u003c/span\u003eentirety.\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027margin-bottom:0in;margin-bottom:.0001pt;text-align:\r\njustify;line-height:normal;mso-pagination:none;mso-layout-grid-align:none;\r\ntext-autospace:none\u0027\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\"Times New Roman\"\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027margin-bottom:0in;margin-bottom:.0001pt;text-align:\r\njustify;line-height:normal;mso-pagination:none;mso-layout-grid-align:none;\r\ntext-autospace:none\u0027\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\"Times New Roman\"\u0027\u003eSection\r\n10 deals with the number of arbitrators. It has \u003cspan style=\u0027letter-spacing:\r\n.2pt\u0027\u003ebeen observed that the said section is silent as regards the \u003c/span\u003e\u003cspan\r\nstyle=\u0027letter-spacing:.05pt\u0027\u003econsequences of an agreement between the parties\r\nto appoint \u003c/span\u003e\u003cspan style=\u0027letter-spacing:-.15pt\u0027\u003eeven number of\r\narbitrators. Whether arbitration agreement will \u003c/span\u003e\u003cspan style=\u0027letter-spacing:\r\n-.05pt\u0027\u003ebecome invalid or unenforceable on account of provision for an \u003c/span\u003e\u003cspan\r\nstyle=\u0027letter-spacing:.1pt\u0027\u003eeven number of arbitrators? It may be noted that\r\nthe policy of \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.5pt\u0027\u003elaw is to uphold arbitration\r\nin such circumstances. it is \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.05pt\u0027\u003esuggested\r\nthat section 10 should be rephrased and a further \u003c/span\u003e\u003cspan\r\nstyle=\u0027letter-spacing:.6pt\u0027\u003eproviso be added to its subsection (1) to the\r\neffect that \u003c/span\u003e\u003cspan style=\u0027letter-spacing:1.15pt\u0027\u003ewhether parties have\r\nagreed on an even number of \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.1pt\u0027\u003earbitrators,\r\nsuch even number of arbitrators shall appoint a presiding arbitrator in\r\naccordance with the provisions of this \u003c/span\u003ePart. Reference may be made to\r\nsection 15(2)4\u003csup\u003e4\u003c/sup\u003e of the English Act.\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027margin-bottom:0in;margin-bottom:.0001pt;text-align:\r\njustify;line-height:normal;mso-pagination:none;mso-layout-grid-align:none;\r\ntext-autospace:none\u0027\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\"Times New Roman\"\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027margin-bottom:0in;margin-bottom:.0001pt;text-align:\r\njustify;line-height:normal;mso-pagination:none;mso-layout-grid-align:none;\r\ntext-autospace:none\u0027\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\"Times New Roman\"\u0027\u003eSection\r\n11 deals with the procedure for the appointment \u003cspan style=\u0027letter-spacing:\r\n.1pt\u0027\u003eof arbitrator(s). Section 11 proceeds on the premise that there \u003c/span\u003e\u003cspan\r\nstyle=\u0027letter-spacing:.05pt\u0027\u003eare only two parties to arbitration. Presently the\r\nfrequency of \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.15pt\u0027\u003econtracts involving more\r\nthan two parties is increasing with \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.2pt\u0027\u003eevery\r\npassing day e.g. syndicated finance agreement. It has \u003c/span\u003e\u003cspan\r\nstyle=\u0027letter-spacing:.15pt\u0027\u003ebeen observed that section 11 is insufficient as\r\nregards the \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.05pt\u0027\u003eprotection of the freedom\r\nof the parties to choose an arbitrator \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.15pt\u0027\u003eof\r\ntheir choice in a situation where there are more than two \u003c/span\u003e\u003cspan\r\nstyle=\u0027letter-spacing:-.1pt\u0027\u003eparties. For instance, a claimant, who has\r\ninitiated arbitration \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.1pt\u0027\u003eagainst more\r\nthan one respondent, may have the arbitrator of \u003c/span\u003e\u003cspan style=\u0027letter-spacing:\r\n.45pt\u0027\u003ehis choice. The respondents may not have the identity of \u003c/span\u003e\u003cspan\r\nstyle=\u0027letter-spacing:.1pt\u0027\u003einterest and one of the respondents wants his\r\narbitrator to be \u003c/span\u003eon panel, whereas, the other respondent wants his\r\narbitrator to \u003cspan style=\u0027letter-spacing:.1pt\u0027\u003ebe on the panel. It \u003c/span\u003e\u003cspan\r\nstyle=\u0027font-size:12.0pt;font-family:\"Times New Roman\";letter-spacing:-.15pt\u0027\u003ehas\r\nbeen observed that section 34 is silent as regards the issue \u003c/span\u003e\u003cspan\r\nstyle=\u0027font-size:12.0pt;font-family:\"Times New Roman\";letter-spacing:.3pt\u0027\u003ewhether\r\nthe right of a party to seek the setting aside of an \u003c/span\u003e\u003cspan\r\nstyle=\u0027font-size:12.0pt;font-family:\"Times New Roman\";letter-spacing:.05pt\u0027\u003eaward\r\nunder section 34 is subject to the provisions of section 4 \u003c/span\u003e\u003cspan\r\nstyle=\u0027font-size:12.0pt;font-family:\"Times New Roman\";letter-spacing:.1pt\u0027\u003eof\r\nArbitration Bill. It may be noted that right to challenge an award under\r\nsection 68\u003csup\u003e6\u003c/sup\u003e of the English Act is subject to the \u003c/span\u003e\u003cspan\r\nstyle=\u0027font-size:12.0pt;font-family:\"Times New Roman\";letter-spacing:-.05pt\u0027\u003eprovisions\r\nof section 73\u003csup\u003e7\u003c/sup\u003e that provides for the waiver of the right to object.\r\nIt is, therefore, suggested section 34 of the Arbitration \u003c/span\u003e\u003cspan\r\nstyle=\u0027font-size:12.0pt;font-family:\"Times New Roman\";letter-spacing:.45pt\u0027\u003eBill\r\nshould be appropriately amended as to provide clarity \u003c/span\u003e\u003cspan\r\nstyle=\u0027font-size:12.0pt;font-family:\"Times New Roman\";letter-spacing:1.0pt\u0027\u003eas\r\nregards the rights to seek the setting aside of an \u003c/span\u003e\u003cspan\r\nstyle=\u0027font-size:12.0pt;font-family:\"Times New Roman\"\u0027\u003eaward.\u003cspan\r\nstyle=\u0027letter-spacing:-.05pt\u0027\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027margin-bottom:0in;margin-bottom:.0001pt;text-align:\r\njustify;line-height:normal;mso-pagination:none;mso-layout-grid-align:none;\r\ntext-autospace:none\u0027\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\"Times New Roman\";\r\nletter-spacing:-.2pt\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027margin-bottom:0in;margin-bottom:.0001pt;text-align:\r\njustify;line-height:normal;mso-pagination:none;mso-layout-grid-align:none;\r\ntext-autospace:none\u0027\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\"Times New Roman\";\r\nletter-spacing:-.2pt\u0027\u003eIt has further been observed that section 34(1) read with\r\n\u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;font-family:\"Times New Roman\"\u0027\u003esection\r\n35(2) of the Arbitration Bill leads to an inconsistency. \u003cspan\r\nstyle=\u0027letter-spacing:.6pt\u0027\u003eSection 34(1) provides that recourse to the court\r\nunder \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.1pt\u0027\u003esubsections (2) and (3) shall be\r\navailable to party unless the \u003c/span\u003ematter is referred by a Court to\r\narbitration. Apparently, section \u003cspan style=\u0027letter-spacing:.05pt\u0027\u003e34 is\r\ninapplicable to awards where the reference to arbitration \u003c/span\u003e\u003cspan\r\nstyle=\u0027letter-spacing:-.05pt\u0027\u003ewas made by the court. However, section 35(2)\r\nthat deals with \u003c/span\u003e\u003cspan style=\u0027letter-spacing:.1pt\u0027\u003epronouncement of\r\njudgment on an award expressly refers to \u003c/span\u003e\u003cspan style=\u0027letter-spacing:\r\n.15pt\u0027\u003echallenge of an award under section 34. This is inconsistent with the\r\nlanguage of section 34(1). It will also \u003c/span\u003e\u003cspan style=\u0027font-size:12.0pt;\r\nfont-family:\"Times New Roman\"\u0027\u003estrengthen arbitration as an institution as it\r\nseeks to strike a \u003cspan style=\u0027letter-spacing:.7pt\u0027\u003ebalance between the right\r\nof the parties to control the \u003c/span\u003earbitration proceedings and the extent of\r\nthe court\u0027s power to \u003cspan style=\u0027letter-spacing:.15pt\u0027\u003esupervise such\r\nproceedings.
