I will add some very\r\nimportant steps which could reduce the delay in disposal \u003cspan\r\nstyle=\u0027mso-bidi-font-size:9.0pt;letter-spacing:.8pt\u0027\u003eof \u003c/span\u003ecases.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003eThe party interested to delay the\r\ncase normally resorts to file different applications. One of which is an\r\napplication under Order VII, Rule 11 of C.P.C. In many of the cases, this\r\napplication is filed without filing the written statement and the purpose\r\nbehind is that the case may be delayed as far as possible. This mala fide act\r\nof the defendant party is preliminarily meant to delay the \u003cspan\r\nstyle=\u0027mso-bidi-font-size:9.0pt;letter-spacing:.8pt\u0027\u003ecase. \u003c/span\u003eIn such a\r\ncase, the Civil Courts shall not entertain such an application unless the\r\nwritten statement is filed within 30 days of filing of the suits.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003eThe other way to delay the case\r\nis that the plaintiff omits to implead the proper/necessary party intentionally\r\nso as to delay the disposal of cases. Now the process to prolong the case\r\nstarts and finally the omitted persons apply for impleadment of parties and\r\nfinally they arc impleaded as parties. This application takes months to decide.\r\nThis process can be quickened and shortened by imposing cost at the rate of\r\nRs.2,000 per party on the plaintiff if and when any party is ordered to be impleaded.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003eWhile framing the issues, the\r\nparties shall be ordered to take note of the issues on the same date and shall\r\nprepare themselves accordingly. The parties must know that no further\r\nopportunity will be given to file list of witnesses within 7 days.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003eIt is known to everybody that the\r\nmain reasons of delay in the suits is caused by making the parties to go\r\nthrough the long process of proving the documents. This process can be\r\nshortened by directing the parties on the date of framing of issues to \u003cspan\r\nstyle=\u0027mso-bidi-font-size:9.0pt;letter-spacing:.8pt\u0027\u003efile \u003c/span\u003edocuments,\r\nadditional or otherwise, within 7 days \u003cspan style=\u0027mso-bidi-font-size:9.0pt;\r\nletter-spacing:.8pt\u0027\u003eof \u003c/span\u003eframing of the issues. The parties shall also be\r\nordered to pass on these documents to the rival party under the letter of\r\nrespective Advocates and the said letter of Advocate shall be ordered to be\r\nplaced on Court file.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003eThe Courts shall give 7 days for\r\nfiling the reply as to if both the parties admit the documents.
