Various modes and techniques have been adopted and followed for\r\ndispute resolution from time to time. For instance direct negotiations (without\r\nthe involvement of any third party) to settle a dispute is an ideal mode\r\nleaving all the parties happy with the outcome of such amicable settlement.\r\nMediation, Conciliation and Arbitration are some of the other modes engaging\r\nthird party intervention of appointing neutral persons to bring about\r\nsettlement of disputes. The society and set-up in which we live, since long the\r\nefforts used to be made to settle the disputes at local levels. All of us must\r\nhave observed or heard of `Punchayats\u0027, `Punchs\u0027 and the `Qazi\u0027 in our villages\r\nand \u0027Gali/Mohallas\u0027 (localities) of towns, settling disputes of people at local\r\nlevel. Though such modes had no specific statutory backing, their verdicts and\r\ndecisions used to be accepted and considered as binding. In our country, those\r\nat the helm of the affairs appear to have paid attention to this aspect. In\r\n1961 Conciliation Courts Ordinance was promulgated providing Conciliation\r\nCourts for this purpose. Specified civil disputes and minor offences could be\r\nresolved through these Courts. Provisions were also made in the Family Laws\r\nmaking it incumbent for the Family Court to strive for, bringing about a reconciliation\r\nfor settling family disputes. For the resolution of labour disputes \u0026quot;shop\r\nstewards\u0026quot; were to act as a link between the workers and the employer to\r\nhelp workers in the solution of their problems connected with the work. The\r\nappointment of \u0026quot;conciliators\u0026quot; was visualized by the Industrial\r\nRelations Ordinance 1969 (now of 2002) to negotiate and to bring about amicable\r\nsettlement of the disputes. Some laws have been enacted in the recent past,\r\nsuch as provisions in the Punjab Local Government Ordinance, 2001 (Sections 102\r\nand 103) constituting `Mosalehat Anjuman\u0027 and `Insaf Committees\u0027 for resolving\r\nlocal disputes. Even the Courts have been empowered to refer cases to Mosalehat\r\nAnjuman (S.104). For settling fiscal disputes relevant Laws have been amended.\r\nAddition of Rule 231-C has been made in the Income Tax Rules, encouraging the\r\nresolution of disputes through Alternate Dispute Resolution Committee.\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003cspan style=\u0027letter-spacing:.2pt\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003cspan style=\u0027letter-spacing:.2pt\u0027\u003eThese\r\nare only few instances indicative of the trend to find ways and means of\r\nsettling and resolving disputes through alternate modes and techniques. Despite\r\nthe availability of such modes there is alarming increase in the number of\r\ncases resulting in long-drawn litigation and burdening the Courts. It is,\r\ntherefore, high time for all of us who are directly linked with the\r\nadministration of justice to thinks about, devise and adopt ways and means to\r\nencourage the dispute resolution through alternate means, preferably the\r\namicable settlement of disputes which ultimately proves beneficial not only to\r\nthe parties, for they get rid of the expensive litigation, but also the Courts\r\nwhose burden is lessened, as in such cases there remains no possibility of\r\nfurther challenge through appeals etc. The recent insertion of section 89-A in\r\nthe Code of Civil Procedure, 1908 can be made use of by the Courts for such\r\npurpose.
