They were very generous in their compliments which,\r\nI do not deserve as, I am conscious of my limitations. However, whatever, I\r\nhave \u003cspan class=GramE\u003eachieved,\u003c/span\u003e I owe it all to the infinite blessings\r\nof Allah Almighty and to the prayers of all my well\u0026#8209;wishers.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e3. I have remained associated\r\nwith the profession of law for about 35 years. Half of the period thereof was\r\nspent at the Bar as a lawyer as well as a Provincial Law Officer and\r\nthereafter, more than 15 years on the Bench.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e4. Whatever has a beginning must\r\nhave also an end, as all of us are mortal. Today is the closing days of my\r\nsitting on the Bench, 12 years thereof were spent in the High Court and more\r\nthan three years in this august Court. Throughout all this period I have always\r\nregarded myself as a humble worker though performing different duty to achieve\r\nsame goal of justice for the downtrodden and oppressed people. Learned lawyers\r\nassist the Court while the presiding \u003cspan class=GramE\u003eofficer decide\u003c/span\u003e\r\nthe same. It is the judicial system which has got a primary importance for the\r\ncommon man. We often quote the saying of Winston \u003cspan class=SpellE\u003e\u003cb\u003eChurchil\u003c/b\u003e\u003c/span\u003e\r\nwhich he stated during the \u003cspan class=GramE\u003esecond world war\u003c/span\u003e that if\r\nthe English Courts are dispensing justice, the \u003cst1:country-region\u003e\u003cst1:place\u003eGreat\r\n  Britain\u003c/st1:place\u003e\u003c/st1:country-region\u003e cannot lose the war. We must not\r\nforget that \u003cspan class=SpellE\u003e\u003cb\u003eHazrat\u003c/b\u003e\u003c/span\u003e\u003cb\u003e Ali (RAD. A.)\u003c/b\u003e stated\r\nmore than 1400 years earlier that \u003cb\u003e\u0026quot;a country/State can survive with \u003cspan\r\nclass=SpellE\u003eKuffar\u003c/span\u003e but not with injustice\u0026quot;. \u003c/b\u003eIt is well\u0026#8209;established\r\nthat the primary duty of the Government is to provide speedy and less expensive\r\njustice to the litigants. However, when we look around we are constrained to realize\r\nthat the ordinary litigant \u003cspan class=SpellE\u003eclamour\u003c/span\u003e for year to secure\r\njustice. Who does not know that litigation in this country is both luxurious\r\nand full of dilatory tactics on the part of unscrupulous \u003cspan class=GramE\u003elitigants.\u003c/span\u003e\r\nIt takes decades for a dispute to the resolve in the Courts of law. Proceedings\r\nare conducted in the civil Courts at a snail pace and continued to be adjourned\r\nwithout any progress. One side enjoys the fruits of interim relief for an\r\nindefinite and indeterminable period without impunity.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e5. I have always during my tenure\r\nas a Judge have discarded and brushed aside the technicalities as they are the\r\nmain stumbling block in our judicial system. The process of law needs a drastic\r\nchange so as to keep up with the needs of the present society. Another factor of\r\nlamentation is regarding the cost of litigation which even on minor issues has\r\nbecome \u003cspan class=GramE\u003eso\u003c/span\u003e exorbitant as to fall out of the reach of a\r\ncommon man. A common man is seldom in a position to cater for the financial\r\nburden of litigation. The State shall provide help in this regard to ameliorate\r\nthe, plight of the poor litigant by creating a pool of lawyers who conduct\r\ntheir cases \u0026#8209;at State expense.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e6. The judicial system of a\r\nsociety comprises of two but I would say three tiers i.e. \u003cspan class=SpellE\u003eHon\u0027ble\u003c/span\u003e\r\nJudges, learned Members of the Bar and the litigant public. There is a century\r\nold maxim that the judiciary and the bar are two wheels of the same chariot.\r\nUnless both synchronize in their movement, this chariot cannot role smoothly.\r\nFor the success of the judicial system, there must be mutual respect, harmony,\r\ncooperation and coordination between the Bench and the Bar. Without their\r\nharmonious relationship the judicial system cannot improve.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e7. The presence of the litigants\r\nin the arena of law is imperative and both Bench and Bar perform their\r\nrespective duties to redress their grievance. It is a misnomer that justice is\r\ndispensed only by the Courts of law. This duty has been cast by Allah Almighty\r\nupon all members of the society whether at home or in their respective profession.\r\nIf everyone is honest in the performance of his duty, then certainly there\r\nwould be less litigation. When a litigant for the first time entrust his brief\r\nto the lawyer he shall not face any hesitation in giving him his honest opinion\r\non the merits of the case. By tendering honest advice, the lawyer would not\r\nonly discourage frivolous litigation but would also save the other party from\r\nuncalled for litigation and expense.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003cspan style=\u0027mso-bidi-font-family:\r\n\"Courier New\"\u0027\u003e8. The judiciary has also to play dominant role to put up the\r\nwheel of justice on proper rail. This can only be achieved if the honest and\r\ndedicated persons with integrity are selected to dispense justice right from\r\nthe Civil Judge up to this Court. A single dishonest appointment without\r\nconsideration of the aforementioned requirements would have adverse effect upon\r\nthe whole system. We often quote a letter written by \u003cspan class=SpellE\u003e\u003cb\u003eHazrat\u003c/b\u003e\u003c/span\u003e\u003cb\u003e\r\nAli (RAD.A.) to \u003cspan class=SpellE\u003eMalik\u0026#8209;Ashtar\u003c/span\u003e,\u003c/b\u003e \u003c/span\u003ethe\r\nGovernor of Egypt respecting the\u0026#8209; appointments of Judges. If the same is\r\nadhered in letter and spirit, I am sure that this society would become worth\r\nliving for mankind. I quote a \u003cspan class=SpellE\u003epara\u003c/span\u003e. \u003cspan\r\nclass=GramE\u003efrom\u003c/span\u003e the said letter which is in the following terms:\u0026#8209;\u0026#8209;\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027margin-left:.5in;text-align:justify\u0027\u003e\u0026quot;For\r\ndispensing justice, you must select people of excellent character and superior\r\ncaliber. \u003cspan class=GramE\u003eWhen they realize that they have committed a mistake\r\nin judgment; they should nut persist upon its justification.\u003c/span\u003e They should\r\nnot be corrupt or greedy and must attach the greatest importance to reasoning,\r\narguments and proofs. Pay them handsomely so that their needs are fully\r\nsatisfied and they do not resort to corruption. \u0026quot;\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003eThe real challenge to the\r\njudicial system in my opinion is \u003cspan class=GramE\u003ethat public at large have\u003c/span\u003e\r\nlost their faith therein.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e9. As already stated above, the\r\nprocedure of technicalities and the gimmickry of the fraudulent litigants have\r\ncompletely shattered the confidence reposed by the general public in the\r\njudicial system. I have recently noticed a case where a person gifted his\r\nproperty to a \u003cspan class=SpellE\u003eYateem\u003c/span\u003e \u003cspan class=SpellE\u003eKhana\u003c/span\u003e\r\nin sixties and the \u003cspan class=SpellE\u003eYateem\u003c/span\u003e \u003cspan class=SpellE\u003eKhana\u003c/span\u003e\r\nfiled an \u003cspan class=SpellE\u003eejectment\u003c/span\u003e petition in the year \u003cspan\r\nstyle=\u0027mso-bidi-font-family:\"Courier New\"\u0027\u003e1980, which was accepted by the\r\nlearned Rent Controller in 1983. The appeal, the Constitutional petition and\r\nthe petition before this Court \u003cspan class=GramE\u003ewas\u003c/span\u003e also dismissed by\r\nthe year 1984. However, the other side through different methods successfully\r\nfrustrated the course of execution for two decades by filing different\r\napplications. I may quote over here that the Judicial Committee of the Privy\r\nCouncil mane observation as far back as in the year 1872 in the case titled\r\n\u0026quot;The General Manager of the \u003cspan class=SpellE\u003eRaj\u003c/span\u003e \u003cspan\r\nclass=SpellE\u003eDurbhunga\u003c/span\u003e, under the Court of Wards \u003c/span\u003ev. Maharajah \u003cspan\r\nclass=SpellE\u003eCoomar\u003c/span\u003e \u003cspan class=SpellE\u003eRamaput\u003c/span\u003e Sing\u0026quot;\r\nregarding the difficulties of the litigant in this part of the World and I\r\nquote the learned law lord that \u0026quot;These proceedings certainly illustrate\r\nwhat was said by Mr. \u003cspan class=SpellE\u003eDoyne\u003c/span\u003e and what has been often\r\nstated before, that the difficulties of a litigant in India begin when he has\r\nobtained a decree.\u0026quot; This situation has not improved after this long period\r\nof more than one and quarter of century. Rather it has worsened and the parties\r\nsuffer agonies of litigation without final determination respecting their cause\r\nfor generations. I have suggested certain measures, which I need not to repeat\r\nover here but I would like to say that it is the duty of the Bench and the Bar\r\nto ensure that the litigant get its grievance redressed at the earliest. The\r\nfraudulent and unscrupulous grabbers should be dealt with an iron hand. A\r\nlearned Judge stated two decades earlier in his address that he would consider\r\nthat day to be a day of Salvation when no settlement case would be pending in\r\nthe superior Courts. I am sorry to say that fraudulent grabbers by forging the\r\npapers and burning the record of properties of main cities have filled the\r\nCourts with bogus claims. There must be some end to all this fraud.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e10. I must not be understood as\r\nhaving given a \u003cspan class=GramE\u003esermon,\u003c/span\u003e I have just expressed my\r\nfeelings and sentiments which I have gathered throughout this long stay in this\r\nprofession. If ever I have injured the feeling of anyone I earnestly \u003cspan\r\nclass=GramE\u003eseeks\u003c/span\u003e forgiveness. I must not forget the \u003cspan class=GramE\u003estaff\r\nof this Court who have\u003c/span\u003e always received me with open arms. They all help\r\nme in the discharge of my duties. I am, again thankful to my lord the \u003cspan\r\nclass=SpellE\u003eHon\u0027ble\u003c/span\u003e Chief Justice, brother Judges and the learned\r\nmembers of the Bar who always showered their love and respect upon me during\r\nthis period.
