Under section 15 of the Ordinance, the Federal Government may, by\r\nnotification in the official Gazette, make rules for carrying out the purposes\r\nof this Ordinance. There\r\nare reports that in some offices the Ordinance is being used to victimize the\r\nofficials/officers who are somehow not in good books of the officers who are at\r\nthe helm of affairs.\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003cspan lang=EN-GB\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003cspan lang=EN-GB\u003eBy introducing\r\namendment in the Civil Servants Act, 1973 and the Ordinance of 2000, it has\r\nbeen provided that no suit, prosecution or other legal proceedings shall be\r\ntaken against the competent authority or an officer or authority authorised by\r\nit for anything which is in good faith done or intended to be done under the\r\nAct, the Ordinance or the rules, instructions or order made or proceedings\r\ntaken shall be called in question in any Court and no injunction shall be\r\ngranted by any Court in respect of any decision made, or proceedings taken in\r\npursuance of any power conferred by or under the Civil Servants Act, 1973 or\r\nthe rules made thereunder. In this way absolute and unbridled powers have been\r\ngiven to the \u0026quot;competent authority\u0026quot; to proceed against the persons in\r\nGovernment or Corporation service and the only remedy available to them is a\r\nrepresentation/review under section 9 of the Ordinance and ultimately an appeal\r\nto the Federal Service Tribunal against the final order. The representation or review\r\nunder section 9 is available against orders passed by competent authority under\r\nsection 3 of the Ordinance and no remedy is available against order of\r\nsuspension under section 4 of the Ordinance, It is pertinent to point out that\r\njurisdiction of the High Court under Article 199 of the Constitution would be\r\navailable to suspend or set aside order which is unfair, unjust as we\u0027ll as\r\ncontrary to the principles of natural justice. In a similar case of suspension\r\nunder section 4 of the Ordinance, the Supreme Court has granted leave to appeal\r\nto examine the question and the order is reported as 2001 `SCMR 1945. While\r\ngiving such absolute powers to the competent authority, no corresponding checks\r\nagainst the illegal exercise of powers by such authority or safeguards to the\r\naccused persons have been provided against mala fide actions. In cases where an\r\naccused feels that the action taken against him is based on mala fide, he\r\ncannot be satisfied with the departmental representation/review as no immediate\r\nrelief in the form of suspension of impugned orders is made available to them\r\nand final decision against which an appeal is provided before the Federal\r\nService Tribunal, takes years to culminate. The employees do not have full\r\nfaith in the working of Service Tribunals as usually the Benches are not\r\ncomplete and the decisions in appeals get delayed for many years. It has been\r\nreported in the press that the Federal Service Tribunal is without a Chairman\r\nfor the last about one month and some Benches are also not complete and\r\nvirtually no relief is available to affected employees.\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003cspan lang=EN-GB\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003cspan lang=EN-GB\u003eIn some cases\r\nthe show\u0026#8209;cause notices are issued by the competent authority and orders\r\nare passed on the basis of replies submitted by the accused to such show\u0026#8209;cause\r\nnotices, without issuing any charge\u0026#8209;sheet accompanied by statement of\r\nallegations, appointment of Inquiry Officer/Inquiry Committee and without\r\nproviding reasonable opportunity of hearing to such person as envisaged in\r\nsection 5 of the Ordinance. When the competent authority passes any order\r\nwithout observing the procedure laid down by the Ordinance, the order passed by\r\nsuch Authority cannot withstand judicial scrutiny. The Superior Courts of\r\nPakistan have already set aside the punishment imposed by competent authority\r\nwhere the proceedings were conducted in violation of the principles and\r\nprocedure laid down to regulate the inquiry proceedings.\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003cspan lang=EN-GB\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003cspan lang=EN-GB\u003eUnder section 9\r\nof the, Ordinance, a representation/review against the orders passed by the competent\r\nauthority under section 3 is available within 15 days. The Establishment\r\nDivision taking notice of non\u0026#8209;observance of the prescribed procedure\r\nissued Office Memorandum No.5/4/94/Rev/D\u0026#8209;3, dated 19\u0026#8209;9\u0026#8209;2001\r\ndirecting that certain essential documents must be sent with the summary of\r\nappeal /representations submitted under section 9 against the orders passed\r\nunder section 3 of the Ordinance. Such essential documents include, (i) charge\u0026#8209;sheet,\r\n(ii) reply of the accused to the charge\u0026#8209;sheet, (iii) inquiry report, (iv)\r\nshow\u0026#8209;cause notice and (v) reply of the accused to the show\u0026#8209;cause\r\nnotice. In such cases, as stated above, where the proceedings are initiated\r\nwith the issuance of a show\u0026#8209;cause notice and order is passed by the\r\ncompetent authority on the basis of reply of the accused to the show\u0026#8209;cause\r\nnotice, there will be no charge\u0026#8209;sheet, no reply of the accused to the\r\ncharge- sheet and no inquiry report. It is to be noted that the issuance of\r\nshow\u0026#8209;cause notice comes at the fourth stage after charge\u0026#8209;sheet,\r\nreply to charge\u0026#8209;sheet and inquiry report which steps are to be taken\r\nprior to the issuance of show\u0026#8209;cause notice but, as stated above, the\r\nproceedings under the Ordinance are started in some departments/corporations,\r\nwith the issuance of show\u0026#8209;cause notice which is not lawful.\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003cspan lang=EN-GB\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003cspan lang=EN-GB\u003eBeing\r\ndissatisfied with the procedure followed while initiating proceedings under the\r\nOrdinance and taking notice of the judicial scrutiny of such matters where\r\nproceedings were conducted in violation of the principles and procedure laid\r\ndown to regulate the inquiry proceedings and consequential reversal of orders\r\npassed by the competent authority on the basis of such proceedings, the\r\nEstablishment Division issued another Office Memorandum No.13\u0026#8209;2\u0026#8209;/2000\u0026#8209;D\u0026#8209;2,\r\ndated 21\u0026#8209;9\u0026#8209;2001 explaining the procedure to be followed while\r\ntaking action under the Ordinance.
