The Constitutional Courts are\r\nbeing pressurized by the executive on this so\u0026#8209;called version that justice\r\ndelayed is justice denied while justice must be administered at every cost and\r\nif justice is rushed then justice is crushed but at the same time inordinate\r\ndelay in disposal of cases can be avoided especially many bail petitions are\r\npending in this Hon\u0027ble Court from time immemorial and the High Court Bar\r\nexpects that every bail application will be disposed of within one month and\r\nthe same should not be prolonged because question of the\u0026#8209;liberty of the\r\ncitizen is involved.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e4. A survey must by conducted\r\nthat how many Judges of the subordinate judiciary are owners of cars and\r\nwhether they can afford to travel daily by car from the place of posting to the\r\nplace of residence. Police officials are State\r\nfunctionaries and their actions are subject to the judicial review under\r\nArticle 199 of the Constitution of Islamic Republic of Pakistan an\r\nauthoritative pronouncement on the subject is the need of the day to resist the\r\npolice atrocities and to grant relief even at the investigation stage. The\r\nmatter may be laid at rest keeping in view the orbit of Article 199 of the\r\nConstitution of Islamic Republic of Pakistan.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e8. In the subordinate Courts, the\r\nJudges as well as lawyers are deprived of the basic facilities, neither there\r\nare appropriate Court rooms nor the Furniture is provided. The subordinate\r\nCourts are performing their functions in very poor conditions while the\r\nexecutive officers i.e. District Magistrate and Assistant Commissioners etc.\r\nare enjoying the facilities and the judiciary is suffering from inferiority\r\ncomplex.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e10. The lawyers quota for the\r\nappointment of Additional District and Sessions Judges has been reduced and\r\nlong standing practice of 25 years has been changed. Bar is not satisfied. The\r\nold quota may be restored and the lawyers quota for the appointment of Sessions\r\nJudges may also be restored.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e11. Carrying of fire\u0026#8209;arm is\r\nstrictly prohibited in the premises of the High Court in view of Order of this\r\nHon\u0027ble Court dated 25\u0026#8209;1\u0026#8209;1968 but generally the police officials\r\nare carrying the fire\u0026#8209;arms in the High Court premises in violation of the\r\nabove-said order.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e14. In view Order No.399, dated\r\n22\u0026#8209;4\u0026#8209;1968, the office is bound to give completion certificate on\r\nthe cases and any incomplete case cannot be fixed before the Honourable Benches\r\nbut in violation of the abovesaid order incomplete cases are being fixed before\r\nthe Hon\u0027ble Benches, thus, wasting the time of the Bench and the Bar. The\r\ncompletion Clerks are not performing their duties as prescribed by the\r\nabovesaid order.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e15. There are general complaints\r\nthat names of the lawyers are not published in the cause list as such the cases\r\nare dismissed in default and ultimately restoration applications are moved,\r\nthus, the work load is being increased due to inefficiency of the office and\r\nthe Computer Section.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e20. The outside counsel is not\r\nintimated time through registered post acknowledgement due and their cases\r\nresultantly are being dismissed in default and a fresh round of litigation\r\nstarts by moving application for restoration. As envisaged by order dated 18\u0026#8209;1\u0026#8209;1967,\r\nthe registered post card of actual d9te should be sent at least with 15 days\u0027\r\nmargin to the outside counsel but the office is not performing its duties.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e21. The delays in the\r\nadministration of justice can be avoided by the uniformity of judgments and\r\ncontradictory judgments can be resolved by referring the matter to the Larger\r\nBenches while contradictory judgments are one of the cause of delay in the\r\nadministration of justice.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e22. The attention may also be\r\ndrawn to this effect that generally the subordinate Courts do not follow the\r\nrule of law laid down by the Constitutional Courts while the decision of the\r\naugust Supreme Court of Pakistan as well as Honourable High Court are binding\r\nupon the subordinate Courts, thus, while exercising supervisory jurisdiction\r\nunder Article 203 of the Constitution of Islamic Republic of Pakistan if a\r\nmatter is brought to the notice of this Hon\u0027ble Court then the said judicial\r\nofficer may be prosecuted for the violation of the Constitution and separate\r\nrules for filing the petition under Article 203 of the Constitution of Islamic\r\nRepublic of Pakistan may please be framed.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e23. The enhancement of court\u0026#8209;fee\r\nis another hurdle in the administration of justice, every one of us is\r\nresponsible to the God if somebody has not access to justice\u0026#8209;due to non\u0026#8209;availability\r\nof funds for the payment of court fee. The concept of payment of court\u0026#8209;fee\r\nis alien to Islam and the matter has already been decided by the Federal\r\nShariat Court, thus, demand of court\u0026#8209;fee upon the Constitutional\r\npetitions may be reduced and there is no logic to recover court\u0026#8209;fee from\r\nthe aggrieved persons, anyhow, court\u0026#8209;fee is tax upon the civilization.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e25. The system of the High Court is\r\ndifferent from the august Supreme Court and from the United Kingdom, thus,\r\ncomplete ban upon the clerks of the counsel will handicap the Bar.
