It is indeed a useful\r\nmeans for redressing the grievances of the people and alleviating their\r\nsufferings and agonies, through speedy disposal of complaints. The institution\r\nis further beneficial for ensuring the accountability of public agencies, by\r\nchecking the abuse and misuse of power by public functionaries. This is\r\nprecisely what the principles of Islamic justice emphasise and has been the aim\r\nof successive Governments in Pakistan.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003eThe Institution of Ombudsman is\r\ntraceable to early Islamic period. The Righteous Caliphs established the Office\r\nof Mohtasib to give redress to the grievances of the people. The Turkish\r\nCaliphate put it on firmer footing. The Envoys of Scandinavian Countries to\r\nTurkey were deeply impressed by the Turkish set\u0026#8209;up and forwarded\r\nfavourable Reports to their Governments. Sweden, after due deliberations\r\nestablished the office of Ombudsman. Other countries followed the pattern. In\r\nPakistan, among others, Chief Justice A.R. Cornelius and Chief Justice Hamood\u0026#8209;ur\u0026#8209;Rehman\r\nsuggested its adoption. In or about 1982 the Draft Ombudsman Order was placed\r\nfor consideration before the Majlis\u0026#8209;e\u0026#8209;Shoora. A heated debate took\r\nplace. Mr. Sharifuddin Pirzada, the then Law Minister gave cogent and\r\nconvincing replies to the critics. The motion was adopted unanimously. Eminent\r\njurists were appointed Ombudsmen, and acting appointments were held by Senior\r\nJudges of the Supreme Court who were nominated by the Chief Justice of\r\nPakistan. The Institution has made great contribution by providing relief to\r\naggrieved persons in cases of maladministration and has proved to be effective\r\nand efficacious remedy. The Supreme Court of Pakistan has, in its judgments,\r\ndealt with provisions of the Ombudsman Order, specially about the Appellate\r\nforum provided therein.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003eWhile speaking of the Institution\r\nof Ombudsman, I should make mention of the Founding Ombudsman of Pakistan,\r\nnamely, Mr. Justice (Retd.) Sardar Muhammad Iqbal, former Chief Justice of\r\nLahore High Court. His exemplary hard work, devotion and dedicated efforts\r\ncontributed a great deal in establishing and institutionalizing the Office of\r\nOmbudsman. His successors have also taken a keen interest in further\r\nstrengthening the Institution of Ombudsman. Knowing as I do know, the judicial\r\nacumen, administrative capability, hard work, devotion to duty and integrity of\r\nMr. Justice Muhammad Bashir Jehangiri, I have no doubt in mind that he would\r\nfollow the rich traditions of his predecessors and be able to further improve\r\nthe performance of the Institution.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003eIn an Appeal before the Supreme\r\nCourt in the case of Federation of Pakistan v. Muhammad Tariq Pirzada (1999\r\nSCMR 2744) followed by Review of the same judgment (1999 SCMR 2189), the Court\r\ndiscussed, inter alia, the performance of this Institution and commended its\r\ncontribution in redressing public grievances through prompt and cheap disposal\r\nof petitions. The Court observed:\u0026#8209;\u0026#8209;\u0026#8209;\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u0026quot;The President under the\r\nOrder is a statutory body and has to function as such under the provisions and\r\nthe scheme envisaged by the Order. It could not be the intention of the\r\nLegislature that disposal of the representation be made in an arbitrary manner.\r\nEven if it is assumed that the institution of Wafaqi Mohtasib is an administrative\r\nbody and the President also acts in administrative capacity while disposing of\r\na petition under Article 32 of the Order, an aggrieved person in whose favour a\r\nrecommendation has been made/finding recorded by the Mohtasib, has legal right\r\nto demand that an adverse decision should not be taken against him in violation\r\nof the principle of natural justice. It is true that there is no provision for\r\naffording a hearing either to the person who lodged a complaint before the\r\nMohtasib or the representationist. Nevertheless, a favourable order having\r\naccrued in favour of a complainant, cannot be brushed aside by setting aside\r\nthe recommendation of the Mohtasib without assigning any reason whatsoever. The\r\nrecording of valid reasons while setting aside the recommendations of the\r\nMohtasib, would be the minimum requirement of law consistent with the principle\r\nof natural justice, under the scheme of the Order. It would be seen that under\r\nArticle 32 of the Order, any conceivable just and proper order can be passed,\r\ndepending upon the facts of each case. The phrase \u0027as he may deem fit\u0027 implies\r\nthat the President has jurisdiction, power and competence to pass all proper\r\nand necessary orders as the facts of each case justify and in doing so he must\r\ndecide rightly and in accordance with law.\u0026quot;\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003eWhile disposing of the review\r\npetition filed by the Federation, it was held:\u0026#8209;\u0026#8209;\u0026#8209;\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u0026quot;It is true that Article 32\r\nof the Order does not prescribe the time within which a representation is to be\r\nfinally disposed of, nevertheless, justice and fair play demand that all such\r\nrepresentations should be disposed of within a reasonable time. On the question\r\nof the quantum of time to be considered as reasonable for disposal of\r\nrepresentations, having regard to the purposes of the Order, we are inclined to\r\nhold that representation under Article 32. of the Order normally should be\r\ndisposed of within 90 days from the date of its presentation, except for valid\r\nreasons existing for extending the time further, under intimation to all\r\nconcerned \u0026quot;\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003eTime and again, the Government\r\nhas issued appropriate directions to the State agencies and public\r\nfunctionaries to follow and implement the orders and decisions of the\r\nOmbudsman. Such directions specifically provide for prompt execution of\r\nOmbudsman\u0027s orders and directions in cases involving the payment of pension,\r\ngratuities and other benefits on retirement and for redressing the grievances\r\nof widows, orphans, invalid and other deserving persons.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003eNothwithstanding the contribution\r\nof the Institution of Ombudsman to the redress of public grievances,\r\nrectification of instances of injustices and provision of prompt and cheap\r\njustice at the doorstep, the common man expects much more. There is always a\r\nscope for improved efficiency and better performance.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003eSystem of administration of\r\njustice in the civilized world including USA, UK, India and Pakistan is\r\nconfronted with work load. If the Judicial System is allowed to function\r\nwithout any let or hindrance and if it works well, the people can live their\r\nlives peacefully and enjoy freedom, security of their persons as well as the\r\nrewards of their labour. If the Judicial System works badly then the lives of\r\nthe people would be marred by constant fear of crime including terrorism.\r\nContinual addition of Judges and Courts in all branches of law is a temporary\r\nsolution to the backlog crises. What is, therefore, required is the strategy to\r\nbe evolved, determining the priorities and objectives in a coherent and\r\nconstructive way. A genuine effort must be made by all and sundry for the maintenance\r\nof independence of judiciary and encouragement of public confidence in the\r\njudicial system.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003eThe independence of judiciary\r\nrequires that the judiciary shall decide matters before it in accordance with\r\nits impartial assessment of the facts and its understanding of the law without\r\nimproper influences, direct or indirect, from any source. The Judiciary in\r\nPakistan is independent.
