My association with Justice\r\nSheikh Riaz Ahmed dates hack to early sixties and, saying it differently,\r\neversince his enrolment as a Pleader in the erstwhile High Court of West\r\nPakistan. I need not repeat his bio\u0026#8209;data and curriculum vitae as the same\r\nhave been recounted admirably by those who have preceded me. His rich\r\nexperience in all the fields of law as a lawyer, Principal Law Officer of the\r\nProvince and Chairman, Punjab Bar Council, Federal Law Secretary and a Judge of\r\nthis Court as also ad hoc Judge, Supreme Court of Pakistan, before the judgment\r\nof the Supreme Court of Pakistan in Judges\u0027 case, will stand him in good stead\r\nin attending to his current responsibilities.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e3. Normally, such occasions have\r\nbeen prefaced with the word \u0027formal\u0027; in the past. I intend to draw your\r\nattention to, among others, the problems with which both, this Court and the\r\nlegal fraternity, are beset. The pendency of cases at the Principal Seat and\r\nthe Benches has attained gigantic proportion. The litigants in general and the\r\nlawyers community in particular, have legitimate complaints to make against the\r\ndelayed resolution of the cases by the judicial wing of the Statecraft.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e4. Sir, the entire lot of powers\r\nstand divided betwixt Legislature, Executive and Judicial wings in any given\r\ndispensation in a written Constitution. The subjection of all concerned, in the\r\nmatter of exercise of their powers, under the Constitution, of necessity, makes\r\nthe Judicial wing of much greater importance in seeing to it that the first two\r\norgans remain within the confines of their jurisdiction in accord therewith.\r\nThe study of a Constitution of any country is nothing more or less than the\r\nstudy of the constraints placed under the law on the exercise of their\r\nrespective powers by the members of the Legislature, the Executive and the\r\nJudiciary. In a Parliamentary form of Government, the law makers/Legislature\r\nand the Executive organ of the State have an edge\u0026#8209;over the personnel in a\r\nPresidential system when it is noticed that the requirements of the Executive\r\nwing can be got fulfilled easily by making laws or by introducing amendments in\r\nthe existing laws, from the competent Legislature. The concentration of the\r\npowers of these two disciplines in a discernible group/groups in the\r\nStatecraft, can present problems of various magnitude for the purposes of their\r\nresolution by the Judicial wing. The increase in State\u0026#8209;activity, has\r\ngiven rise to complex\u0026#8209;problems to be tackled and resolved strictly in\r\naccord with the Constitution and the law. That litigation has increased in the\r\npast about half a century, is stating the too obvious. The increase in\r\nlitigation and corresponding increase in the number of membership of the legal\r\nprofession, at all levels in the country, has brought to the fore the need for\r\nhaving greater number of persons in the Judiciary, at all levels.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e5. Sir, you are already cognizant\r\nof the enormity of the situation and the problem to that extent can be attended\r\nto by issuing appropriate directions to the lower judiciary and sorting out the\r\ncases in this Court, in a chronological order. I assure you that any remedial\r\nmeasures to be initiated by you with a view to completely and effectively doing\r\naway with the backlog, will have our fullest support. The cases on the civil,\r\ncriminal, company, taxation, rehabilitation and other facets or branches of the\r\nlaw can be assigned to appropriate Benches to be constituted at the Principal\r\nSeat and the Benches. It is heartening to note that you have revised the roster\r\nof sittings commencing 2nd of June, 1997. Three Division Benches at the\r\nPrincipal Seat each for LPAs, ICAs and RFAs and Murder References and Criminal\r\nAppeals as also one Division Bench for \u0027Special Court Appeals\u0027 in addition to\r\n32\u0026#8209;Single Benches, will go a long way in resolution of the causes both in\r\nthe category of pending matters and new institutions.
