He should also know which one of the parties is in\r\nthe right. He should put forward only such arguments as are right in his own\r\nopinion. It is a proved fact from the\r\nancient history that legal profession was in existence even at the time of Greek.\r\nIn this regard reference may be given of famous case of `Suqrat\u0027 which was\r\ncontested on behalf of the State by three advocates viz. Melytus, Anytus and\r\nLycon which had been heard by 501 Judges out of whom 280 delivered their\r\njudgment against `Suqrat\u0027 while 221 pronounced their judgment in his favour.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e3. If we look into the history of\r\nlegal profession we will discover that initially the persons motivated with the\r\ndesire to render social service used to provide legal aid to the needy people\r\ngratuitously. However, with the passage of time and with the industrial and\r\ncommercial growth the legal profession came into existence in its present form.\r\nA few centuries back a lawyer in England used to feel insulted if a client was\r\nto pay his fee in cash into his hands. In order to avoid this a pocket on the\r\nback side of gown was provided where the client used to put fee without even\r\nshowing it to his lawyer. Though the legal profession provides livelihood to\r\nthe lawyers\u0027 community but it is a secondary consideration, the main object\r\nbeing to render service to the community and to contribute towards keeping\r\nstreams of justice clear and pure. The legal profession has been a difficult,\r\nprofession for a beginner everywhere. Only the people belonging to the families\r\nhaving sound financial background used to join the legal profession as there is\r\nalways a waiting period for p young lawyer, which may be between 5 to 10 years.\r\nLord Denning in his well\u0026#8209;known book \u0026quot;The Due Process of Law\u0026quot; at\r\npage 89 has described his initial period in the legal profession in the\r\nfollowing words:\u0026#8209;\u0026#8209;\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u0026quot;I well remember when I was\r\nyoung at the Bar\u0026#8209;\u0026#8209;and expecting a client. I would set out on my\r\ntable the briefs and cases for opinion, all tied up in red tape so as to seem\r\nbusy. But most of them would be `dead\u0027! They had been finished and done with\r\nlong before. It will be regret to say that nowadays the new entrants into the\r\nlegal profession particularly in Azad State of Jammu and Kashmir want to earn\r\nhandsome amount straightaway without having arty waiting period. Furthermore\r\nthere is no effective check or control as to the type of the person who can\r\njoin the legal profession.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e4. People who belong to legal\r\nfraternity feel extreme trouble when they are not being given an opportunity to\r\nplace their case before a Court of law. In this respect here I would like to\r\ntake benefit of a question from a thesis of Mr. Justice (Retd.) Sardar Muhammad\r\nIqbal Khan read by his Lordship in Fourth Judicial Conference held in\r\nMuzaffarabad, Azad Kashmir in 1984:\u0026#8209;\u0026#8209; \u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u0026quot;The Bar is there to assist\r\nthe Bench in administering law. Lawyers, therefore, cannot disassociate\r\nthemselves from the Bench by thinking that they are separate entity altogether.\r\nAlso in my view the Judge who thinks that lawyers are a nuisance is a greatly\r\nmistaken. Even if he were a Salomond or Daniel he would not be able to\r\nadminister justice properly without the aid of the Bar. If he thinks he can,\r\nthen he has no idea of his shortcomings. Anyone like myself who has had\r\nexperience both as a Judge and as a lawyer knows that it is impossible for any\r\nJudge whosoever talented and experienced he may be, to see both sides of\r\npicture. Justice cannot be one\u0026#8209;sided dispensation. The Bench must have\r\nrespect for the Bar, just as the bar is required to have respect for the Bench.\r\nThe lawyer has to avoke the Judge\u0027s admiration for his legal presentation while\r\nthe Judge has to inspire confidence in the lawyer, They are like the sun and\r\nmoon. The beauty of the moon is there for all to seek but it takes light from\r\nthe sun. If there is no sun there will be no light in the moon.\u0026quot;\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e5. Another great problem is faced\r\nby the lawyers\u0027 community when a court of law starts its Court work at 1\u0026#8209;00\r\np.m. or 12\u0026#8209;00 noon or even after 10\u0026#8209;00 a.m. instead of 8\u0026#8209;30\r\nor 9\u0026#8209;00 a.m. No doubt a Presiding officer may be busy some times in\r\ndictating any judgment but in such like eventualities the cases can be\r\nadjourned in early hours so that whole day of lawyers cannot be wasted. I\r\ncannot remain silent here to appreciate and admire the Honourable Supreme Court\r\nwhich starts its Court functions exactly at 8\u0026#8209;30 a.m. during summer\r\nseason and 9\u0026#8209;30 a.m. during winter season without even delay of single\r\nminute. It is hoped that this beautiful principle shall also be followed by all\r\nother Courts.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e6. It is a matter of common\r\nknowledge that inter alia, the standard of the legal education has been\r\ndeteriorated considerably not only in Azad State of Jammu and Kashmir but in\r\nother countries as well. The standard of legal education should be improved and\r\nthe entry to the legal profession should be made difficult. In Azad Kashmir the legal\r\neducation may be bifurcated into two stages: (i) academic, and (ii) vocational\r\ntraining. The academic examination may be conducted by a University whereas\r\nVocational examination may be organized by an institute to be established by\r\nthe Bar Council, of course after adopting Bar Councils Act, 1973 of Islamic\r\nRepublic of Pakistan. \u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003c![if !supportEmptyParas]\u003e\u0026nbsp;\u003c![endif]\u003e\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003eThe role of an advocate in a\r\ndeveloping society is highly, appreciative. This role grows with the role of\r\nJudges. As advocates\u0027 input is often crucial not only to the outcome of a case but\r\nalso to the quality and the authority of the decision arrived at by the Court.\r\nIt is only through this sort of cooperation between Judges and advocates that\r\nthe judiciary and other branches of Government will be able to achieve through\r\nlaw the attainment of the goals they foundly seek.
