Nusrat, J. who, after an illustrious\r\ncareer on the Bench of the Sind High Court and this Court, lays down the robes\r\nof his high office today. The reason I requested my Lord the Chief Justice for\r\nmy association in this event of today is my long association with Mr. Justice\r\nNusrat eversince, we were at the Bar together for more than 40 years, from 1948\r\nin the same Building, yet known as Court-Chambers, Karachi, from where we made\r\nour humble start of life as Advocates of the then Chief Court of Sind. We\r\nstruggled together, in the start of our professional life, when we had briefs\r\nin almost every Court or Tribunal be that the Court of a Civil Judge or a\r\nMagistrate, the office of Rent Controller or Custodian Department, Chief Court\r\nof Sind, which had also the Original, Civil and Criminal Jurisdiction; and\r\nafterwards, the District and Sessions Courts when these were set up in 1956,\r\nand in the course of events, we, however, confined our practice to the High\r\nCourt. Our association together was almost daily in Courts and in Chambers in\r\nthe same Building afterwards on the Bench and the Bar, and then together on the\r\nBench, eversince Mr. Justice S.A. Nusrat was elevated on the Sind High Court\r\nBench in early 1977. These twelve years of our lives together on the Bench of\r\nthe High Court and this Court have been very immemorial. My brother S.A. I bow my head to Almighty Allah for having afforded me\r\nan opportunity to have discharged the heavy duty of dispensing justice to the\r\nbest of the limited capacities of a mortal and to the satisfaction of my\r\nconscience. Justice is a divine attribute and in Islam it is placed on the\r\nhighest pedestal as it is the most sacred duty of the State. I would, however, like to add\r\nthat the judicial acumen and administrative experience that I imbibed on the\r\nBench and by being at the Bar have been very rewarding. I should like to draw\r\nthe attention of the distinguished audience to the Objectives Resolution\r\nenshrined in the 1973 Constitution, wherein the citizens of \u003cst1:country-region\u003e\u003cst1:place\u003ePakistan\u003c/st1:place\u003e\u003c/st1:country-region\u003e\r\nhave been called upon to observe the principles of democracy, freedom,\r\nequality, tolerance and social justice, as enunciated by Islam. It has been my\r\nendeavour to keep these principles as my guides in my role as an Advocate, a\r\nJudge and the Chief\u0027 Election Commissioner.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e5. On this occasion, I wish to\r\npay my special tribute to the Hon\u0027ble Chief Justice Mr. Justice Muhammad Haleem\r\nfor the inspiration and guidance provided by him to me while I was at the Bench\r\nof this Court. His judicial wisdom and proverbial sagacity of a Solon enabled me\r\nto inculcate and acquire many useful insights into the recent developments \u003cspan\r\nstyle=\u0027letter-spacing:.9pt\u0027\u003ein \u003c/span\u003econstitutional jurisprudence. My\r\ncolleagues on the Bench also extended their generosity enabling me to share\r\nmany useful experiences and intricacies of law. I am grateful for the\r\ncongeniality with which I was treated by all concerned in the spheres of my\r\nofficial assignments. I hope that the wisdom and prudence that spiral from the\r\npersons of the Hon\u0027ble Chief Justice, and of the distinguished and learned\r\nJudges of the Supreme Court and members of the legal profession would brighten\r\nwhatever calling that is now waiting for me in the rest of my life.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e6. During last several years, my\r\nmain concern had been to work as the Chief Election Commissioner under the\r\nframework provided for my activities by the law from time to time. I must say\r\nthat it was a very challenging job, which was exposed to stresses, strains,\r\npressures, and extraordinary situations. It was a sheer coincidence and\r\naccident of history that I was called upon to play my humble role at an\r\nimportant and decisive juncture of \u003cst1:country-region\u003e\u003cst1:place\u003ePakistan\u003c/st1:place\u003e\u003c/st1:country-region\u003e\u0027s\r\nhistory in holding the National and Provincial Elections of 1988, which restored\r\nthe democratic institutions after a long interregnum of authoritarian rule. But\r\nfirst in this respect, I would like to state the great role the judiciary has\r\nplayed in creating the situation and circumstances, which alone made this great\r\nhistoric achievement possible. Indeed it can be rightly said that in 1988\r\nelections the judiciary\u0027s role was pivotal which by its monumental verdicts on\r\nelection matters, made it possible to produce the results, through the\r\nelections, which are a great watershed in \u003cst1:country-region\u003e\u003cst1:place\u003ePakistan\u003c/st1:place\u003e\u003c/st1:country-region\u003e\u0027s\r\nconstitutional history and evolution of democratic processes. The importance of\r\npolitical parties in parliamentary democracy as envisaged in the Constitution\r\nwas examined by this Court \u003cspan style=\u0027letter-spacing:.9pt\u0027\u003ein \u003c/span\u003ethe case\r\nof Benazir Bhutto v. Federation of Pakistan, which is indeed a highly valuable\r\nand learned thesis on the subject. The foundation of 1988 .Elections is rooted\r\nin this judgment and in the later case of Haji Saifullah Khan by which the\r\nelection dates of 16th and 19th November, 1988 were given legal sanction and\r\nmade irreversible, leaving no room for any adventurism by any quarters. This\r\nCourt has since then rendered several valuable judgments of equal importance in\r\nthe matters of allocation of symbols, use of identity cards and the\r\njurisdiction of the High Court under Article 199 of the Constitution in\r\nelection disputes.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e7. It is quite obvious that\r\nwithout having the independence of the judiciary, the Election Commission\r\ncannot act without that quantum of impartiality that is necessary for holding\r\nelections that can command total trust and confidence of the nation. Only\r\njudiciary is capable of it and has that degree of prestige in the nation that\r\nis required for the Election Commission.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e8. It was a matter of great\r\ninterest for me to observe that the political parties encouraged the legitimate\r\nchannelling of competition. It has enabled the nation to launch a great\r\nexperiment \u0026quot;with democracy\u0026quot; and \u0026quot;in democracy\u0026quot;. Thus, the\r\ncompetitive electoral context, with political parties organizing the\r\nalternatives that faced the voters, \u003cspan class=GramE\u003ewere\u003c/span\u003e the\r\ndistinguishing elements of the contemporary democratic experience in \u003cst1:country-region\u003e\u003cst1:place\u003ePakistan\u003c/st1:place\u003e\u003c/st1:country-region\u003e.\r\nWhile organizing elections at the national level, I witnessed the force of the\r\nargument that holding elections \u003cspan style=\u0027letter-spacing:.9pt\u0027\u003eon party \u003c/span\u003ebasis\r\nis essential for a strong democracy. The system of political parties\r\nconstitutes\u0027 an important linkage between the social, economic and\r\nConstitutional setting on the one hand and political performance on the other.\r\nOf course political party system has autonomous influence of its own. I made an\r\nattempt to reconcile these perspectives with the concepts of justice and\r\nconstitutionalism with which I was professionally associated. I am inclined to\r\nfeel that linkages between political parties, elections and the administration\r\nof justice would be conducive to strong democratic performance. I am convinced\r\nthat free participation of citizens in the national political process alone\r\nbestows legitimacy to any Government.\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e9.
