He\r\nhas had a promising career both as a lawyer and a Judge, and we will all\r\ncherish memories of his enlightening company in the years to come. I was greatly influenced by his\r\nbenign qualities and his knowledge which had a great impact on my career as \u003cspan\r\nstyle=\u0027mso-bidi-font-size:10.0pt;letter-spacing:.3pt\u0027\u003ea \u003c/span\u003estudent.\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e4. Mr. Justice S.A. \u003cspan\r\nclass=SpellE\u003eNusrat\u003c/span\u003e is unassuming, modest and soft-spoken. As a Judge he\r\nhas displayed exemplary qualities of patience and understanding of human\r\naffairs which have enriched his opinions. His opinions are balanced and bear\r\nout his industry, devotion to duty, and a rich application of judicial\r\nprinciples. His expression is clear and unambiguous and evidences a full grasp\r\nof facts and law arising in the \u003cspan class=GramE\u003ecase,\u003c/span\u003e It has always\r\nbeen stimulating for me to sit with him on the Bench, because of his quick\r\nunderstanding of the points in issue and the manner in which they were to be\r\ndealt with. In particular his understanding of income-tax law was always\r\nbeneficially felt and his opinions in income-tax cases are of high distinctive\r\nvalue.\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e5. I had taken the Law\r\nDegree, a year earlier, and after Partition, we \u003cspan class=SpellE\u003epractised\u003c/span\u003e\r\nin the same High \u0027Court for many years. He was highly successful in the\r\nprofession and had a lucrative practice and commanded great respect of the\r\nmembers of legal fraternity. During his career as a lawyer, he served as Legal\r\nAdvisor to the Income-Tax Department for the Provinces of \u003cspan class=SpellE\u003eSind\u003c/span\u003e\r\nand \u003cst1:place\u003e\u003cspan class=SpellE\u003eBaluchistan\u003c/span\u003e\u003c/st1:place\u003e, and also\r\nserved for one term as the elected President of the \u003cspan class=SpellE\u003eSind\u003c/span\u003e\r\nHigh Court Bar Association which has been an office of great \u003cspan\r\nclass=SpellE\u003ehonour\u003c/span\u003e and eminence. He was elevated to the Bench of the\r\nHigh Court of \u003cspan class=SpellE\u003eSind\u003c/span\u003e on \u003cst1:date Month=\"2\" Day=\"26\"\r\nYear=\"1977\"\u003e26th February, \u003cspan style=\u0027mso-bidi-font-size:8.0pt;letter-spacing:\r\n .2pt\u0027\u003e1977\u003c/span\u003e\u003c/st1:date\u003e\u003cspan style=\u0027mso-bidi-font-size:8.0pt;letter-spacing:\r\n.2pt\u0027\u003e, \u003c/span\u003eand became the permanent Judge of that Court on \u003cst1:date\r\nMonth=\"2\" Day=\"26\" Year=\"1979\"\u003e26th February, \u003cspan style=\u0027mso-bidi-font-size:\r\n 8.0pt;letter-spacing:.2pt\u0027\u003e1979\u003c/span\u003e\u003c/st1:date\u003e\u003cspan style=\u0027mso-bidi-font-size:\r\n8.0pt;letter-spacing:.2pt\u0027\u003e. \u003c/span\u003eWhile serving as Judge of that Court, he \u003cspan\r\nstyle=\u0027mso-bidi-font-size:10.0pt\u0027\u003ewas \u003c/span\u003eappointed as Secretary to the\r\nGovernment of Pakistan in the Ministry of Law and Parliamentary Affairs in\r\nJuly, 1980. He was appointed as permanent Judge of the Supreme Court on 4th of\r\nAugust, 1981, but continued to serve as Secretary, for some time, which post\r\nwas upgraded to that of Principal Secretary in the same Ministry. In addition\r\nto his duties, he was appointed as the Acting Chief Election Commissioner of \u003cst1:country-region\u003e\u003cst1:place\u003ePakistan\u003c/st1:place\u003e\u003c/st1:country-region\u003e\r\nin March, 1982, .which office he has been holding until today.\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003cspan style=\u0027mso-bidi-font-size:\r\n8.0pt\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/span\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003cspan style=\u0027mso-bidi-font-size:\r\n8.0pt\u0027\u003e7. \u003c/span\u003eMr. Justice S. A. \u003cspan class=SpellE\u003eNusrat\u003c/span\u003e has had\r\nmultifarious experiences to his credit as a result of his varied assignments.\r\nHe has attended important international conferences and richly contributed\r\ntowards the growth of law in diverse fields. He headed the delegation of the\r\nElection Commission to \u003cst1:country-region\u003e\u003cst1:place\u003eSwitzerland\u003c/st1:place\u003e\u003c/st1:country-region\u003e,\r\n\u003cst1:country-region\u003e\u003cst1:place\u003eTurkey\u003c/st1:place\u003e\u003c/st1:country-region\u003e and the\r\nFederal Republic of Germany, to study the election systems in those countries.\r\nHe was invited by the British Government to visit the \u003cst1:country-region\u003e\u003cst1:place\u003eUnited\r\n  Kingdom\u003c/st1:place\u003e\u003c/st1:country-region\u003e in March, 1988, to study the\r\nelectoral system of that country.\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e8. \u003cspan\r\nstyle=\u0027mso-spacerun:yes\u0027\u003e \u003c/span\u003eHis most important contribution is the\r\norganizing and the holding of fair and impartial general elections of the\r\nNational and Provincial Assemblies in November, 1988, under \u0027the, \u003cspan\r\nstyle=\u0027mso-bidi-font-size:8.0pt\u0027\u003e1973 \u003c/span\u003eConstitution, which\u0027 received\r\nwidespread approbation in many parts of the world. The elections thus gave\r\nlegitimacy to the will of the people and led to the induction of Governments\r\nboth at National and Provincial levels and upheld the idea of democracy in a\r\nplural society by enforcing the democratic provisions of the Constitution, that\r\nis, the right to assemble peacefully, the right to be a member of the political\r\nparty and the representation of the people through the party-based elections.\r\nIt marked the enhancing virtues of citizen\u0027s voting participation giving rise\r\nto symbols of continuity and change in the political process which has ushered\r\nin an era of confidence of citizens in the political future of the country by\r\nreviving the norms of democracy and thus strengthening the rule of law and the\r\nsupremacy of the Constitution. This has been the turning point in the political\r\nhistory of the country and has cleared the gloom and uncertainty hovering over\r\nthe nation.
