His rich\r\nbackground of tackling ticklish legal problems as a lawyer and his insight of\r\nhuman problems has had a great bearing in the formulation of his opinions. His judgments\r\neloquently speak of his judicial experience, learning, grasp of law and facts\r\nand the facility with which he expressed his opinions.\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003eThe year 1988 was an era of\r\nconstitutional distress. The Parliament and the Provincial Assemblies had been\r\ndissolved and there was a controversy as regards the holding of elections on\r\nparty basis in the context of the constitutional provisions and the Political\r\nParties Act containing the arbitrary provision to restrain and restrict the\r\nfunctioning of the political parties unless registered to contest the\r\nelections. There was thus a challenge to constitutionalism and a denial of the\r\nfundamental right to the citizens to form or to be a member of a political\r\nparty and to participate in the elections on party basis. Not only this, the\r\ndissolution of the Parliament and the Provincial Assemblies also became a live\r\nissue. The Court being the guardian of the Constitution itself and the sentinel\r\nof the rights guaranteed to the citizens had to meet the challenge in disputes\r\nbrought before it for adjudication. It was in this background that Mr. Justice\r\nAslam Riaz Hussain stood by the unanimity of the Court in its several decisions\r\nto uphold the constitutional rights of the citizens, the rule of law, and the\r\ndemocratic polity of the State as envisaged in the Constitution unhindered by\r\nany personal prejudices or political considerations, sentiments or emotions. Talented as he was, he brought\r\nto bear his legal knowledge to successfully pleading the intricate questions of\r\nlaw and thereby discharged the onerous responsibility on his shoulders as a law\r\nofficer. It was his professional craftsmanship, diligence, and his insight of\r\nlaw that gave him an edge over the others and contributed towards his elevation\r\nto the Bench.\u003co:p\u003e\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003e\u003co:p\u003e\u0026nbsp;\u003c/o:p\u003e\u003c/p\u003e\r\n\r\n\u003cp class=MsoNormal style=\u0027text-align:justify\u0027\u003eMr. Justice Aslam Riaz Hussain\r\nhas acted as Chief Justice of Pakistan on several occasions during my absence\r\nabroad and\u0027 is currently holding the charge of Acting Ombudsman. He is an excellent conversationalist,\r\nand by nature is modest and soft-spoken. He returned home the same year and joined\r\nthe Bar. He was elevated to the Bench of the erstwhile High Court of West\r\nPakistan in January, 1970, and was appointed Chief Justice of the Lahore High\r\nCourt in October, 1976.
